INVOCATION, PLEDGE & ROLL CALL Mayor Pro Tern Freeman gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Special Session on Tuesday, August 19, 2014 at 4:10 p.m. in the City Council Chambers, City Hall, with the following members present: Mayor Deloris "Bobbie" Prince; Mayor Pro Tern Derrick Freeman; Councilmembers Raymond Scott, Jr., Tiffany Hamilton, Morris Albright, III., Stephen A. Mosely, Robert E. "Bob" Williamson and Kaprina Frank; Interim City Manager John A. Comeaux, P.E., City Secretary Sherri Bellard and City Attorney Valecia Tizeno. Councilmember Willie "Bae" Lewis, Jr. joined the Special Executive Meeting at 4:30 p.m. II. *CLOSED MEETING (EXECUTIVE SESSION) Closed Meeting: (1) Section 551.071 Government Code — To Discuss With The City Attorney Potential Litigation As It Pertains To Industrial District Agreements And Legal Issues Related To Potential Tax Abatements (2) Section 551.071 Government Code — To Discuss With The City Attorney Potential Litigation With Texas Gas Service (3) Section 551.072 Government Code — To Discuss The Value Of The Land At Pleasure Island (4) Section 551.072 Government Code — To Discuss The Value Of The Land On The Westside (5) Section 551.072 Government Code — To Discuss The Value Of Land At 3451 57th Street (6) Section 551.072 Government Code — To Discuss The Value Of The Land In The City's Extraterritorial Jurisdiction (ETJ (Orange County) (7) Section 551.087 Government Code — To Discuss Incentives For Commercial, Residential, And /Or Industrial Business Prospects (GBM Globe Texas, LLC) The City Council recessed their meeting at 4:10 p.m. to meet in Executive Session to consider the above-mentioned topics, and reconvened their meeting at 5:36 p.m. with the following members present: Mayor Prince; Councilmembers Scott, Hamilton, Mosely, Lewis, Williamson and Frank; Interim City Manager Comeaux; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Blanton. MOTIONS IN OPEN SESSION Motion To Allow The City Manager To Make Payments To Bracewell & Giuliani As It Pertains To Potential Litigation For Industrial District Agreements And Tax Abatements In An Amount Not 0 Exceed An Additional $5,000.00 (1 Year) The motion was made by Councilmember Frank and seconded by Councilmember Williamson that the above-mentioned motion be adopted. The following roll call vote was taken on the motion to adopt the above-mentioned motion: Councilmember Frank "Yes" Councilmember Hamilton "Yes" Councilmember Lewis "Yes" Councilmember Mosely "Yes" Councilmember Scott "Yes" Councilmember Williamson "Yes" Mayor Prince The above-mentioned motion was adopted. Motion To Allow The City Manager And City Attorney To Enter Into An Agreement With Bracewell & Giuliani Regarding The Value Of Land In The City's ET] In Orange County In An Amount Not To Exceed $40,000.00 (1 Year) The motion was made by Councilmember Williamson and seconded by Councilmember Frank that the above-mentioned motion be adopted. The following roll call vote was taken on the motion to adopt the above-mentioned motion: Councilmember Frank "Yes" Councilmember Hamilton "Yes" Councilmember Lewis "Yes" Councilmember Mosely "Yes" Councilmember Scott "Yes" Councilmember Williamson "Yes" Mayor Prince "Yes" The above-mentioned motion was adopted. Motion To Extend The Franchise Agreement With Texas Gas Service From August 20, 2014 To September 3, 2014 The motion was made by Councilmember Williamson and seconded by Councilmember Frank that the above-mentioned motion be adopted. The following roll call vote was taken on the motion to adopt the above-mentioned motion: Councilmember Frank "Yes" Councilmember Hamilton "Yes" Councilmember Lewis "Yes" Councilmember Mosely "Yes" Councilmember Scott "Yes" Councilmember Williamson "Yes" Mayor Prince "Yes" The above-mentioned motion was adopted. III. ADJOURNMENT Upon the motion by Councilmember Williamson, seconded by Councilmember Frank and carried unanimously, the City Council adjourned their Special Meeting at 5:40 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
