HomeMy WebLinkAboutPR 18550: APPOINTING/REAPPOINTING MEMBER OR MEMBERS TO THE CIVIL SERVICE COMMISSION City of Port Arthur Human Resources MEMO To: Mayor and City Council From: John A Comeaux,PE,Interim City Manager Date: September 22,2014 Re: Adoption of Proposed Resolution No. 18550 confirming the Reappointment of Cal Rutherford as a Member of the Civil Service Commission of the City of Port Arthur Recommendation: I recommend that the City Council adopt proposed Resolution No. 18550 which confirms the reappointment of Cal Rutherford as a member of the Civil Service Commission of the City of Port Arthur. Background: Pursuant to Local Government Code Section 143.006 of the Texas Local Government Code,the Chief Executive Officer of a municipality is required to appoint members to the Civil Service Commission. Mr. Rutherford is being selected to continue another term. Budgetary/Fiscal Effect: Acceptance of this recommendation will have no budgetary or fiscal effect. Staffing/Employee Effect: Acceptance of this recommendation will have no staffing or employee effect. Summary: I recommend that the City Council adopt proposed Resolution No. 18550 which confirms the reappointment of Cal Rutherford as a member of the Civil Service Commission of the City of Port Arthur. • Page 1 P. A RESOLUTION APPOINTING AND/OR REAPPOINTING A MEMBER OR MEMBERS TO THE CIVIL SERVICE COMMISSION OF THE CITY OF PORT ARTHUR WHEREAS, Cal Rutherford is duly qualified to be reappointed to the Fire Fighters' and Police Officers' Civil Service Commission pursuant to Section 143.006 of the Texas Local Government Code; and, WHEREAS,the City Manager is reappointing Cal Rutherford as a member of the Civil Service Commission; and, WHEREAS, pursuant to Section 143.006 (c)(1), a commission member may not be reappointed to more than a third consecutive term unless the member's appointment to a fourth or subsequent consecutive term is confirmed by a two-thirds majority of all the members of the municipality's governing body. WHEREAS, the City Council concurs in such appointment. NOW THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1: That the facts and opinions in the preamble are true and correct. Section 2: That pursuant to Section 14-151 of the Code of Ordinances and Chapter 143 of the Texas Local Government Code, the reappointment of Cal Rutherford to serve on the Fire Fighters' and Police Officers' Civil Service Commission for the City of Port Arthur, is hereby confirmed. Section 3: That after taking the oath of office, the said Cal Rutherford shall have all the rights and powers provided by the Statutes, Charter, and Ordinances thereunto appertaining. Section 4: That Cal Rutherford shall serve for a term, commencing September 29, 2014 and terminating September 28, 2017. Section 5: That a copy of the caption of this Resolution be spread upon the Minutes of the City Council of the City of Port Arthur. P. R.
