Polka, P.E., Director of Public Works/City Engineer DATE: September 22, 2014 RE: Proposed Resolution No. 18557 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18557 awarding a bid and authorizing the execution of a contract for the 9th Street Paving and Drainage Improvements Project with DBS Constructors, LLC dba MK Constructors, of Vidor, Texas, having submitted the lowest and most responsive bid in the amount of $679,545.00. Contract time is 180 calendar days. BACKGROUND This is a Hurricane Recovery Grant Round 2.1 administered by the Texas General Land Office which is the funding source for this project. The project includes storm sewer work and the installation of new curb and gutters and street reconstruction/resurfacing on 9th Street between Williams Avenue and Duff Drive, and on Duff Drive south of 9th Street. Bids were received from three (3) qualified bidders, with MK Constructors submitting the lowest and most responsive bid for the project, and which was below the estimated cost. Other bidders for the project were McInnis Construction at $680,266.14 and APAC-Texas at $758,693.50. BUDGET/FISCAL EFFECT Funding for this particular project is provided in Project No. I219TH, Account 144-1201- 532.59-00, which will require a budget adjustment within the GLO Round 2.1 project funds. Major funding for the adjustment do the above described project work on 9th Street comes from savings on other GLO Round 2.1 projects, either after bidding or as the result of some projects having to be cut early in the program. SUMMARY I recommend that the City Council approve Proposed Resolution No. 18557. P.R. No. 18557 9/22/14 sjp RESOLUTION NO. A RESOLUTION AUTHORIZING THE AWARD OF BID AND THE EXECUTION OF A CONTRACT FOR THE 9th STREET PAVING IMPROVEMENTS PROJECT — WILLIAMS AVENUE TO DUFF DRIVE, AND ON DUFF DRIVE SOUTH OF 9TH STREET, WITH DBS CONSTRUCTORS, LLC, DBA MK CONSTRUCTORS, OF VIDOR, TEXAS IN THE AMOUNT OF $679,545.00, GLO ROUND 2.1 PROGRAM, PROJECT NO. I219TH, ACCOUNT NO. 144-1201-532.59-00. WHEREAS, the Texas General Land Office (GLO) has approved funding for the 9th Street Paving Improvements Project; and, WHEREAS, the Public Works Department, Arceneaux Wilson & Cole LLC, and the Purchasing Division have solicited bids for the project; and, WHEREAS, the bids have been evaluated by Arceneaux Wilson & Cole LLC, and their Recommendation of Award and Bid Tabulation is attached as Exhibit "A"; and, WHEREAS, DBS Constructors, dba MK Constructors, of Vidor, Texas has submitted the lowest responsive bid in the amount of$679,545.00; and, WHEREAS,the contract time is 180 calendar days; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. No. 18557 9/22/14 sjp Page 2 of 4 THAT, the award of bid for the 9th Street Paving and Drainage Improvements Project is hereby made by the City Council to DBS Constructors, dba MK Constructors, of Vidor, Texas, in the amount of$679,545.00 and for 180 calendar days; and, THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, the City's standard construction contract between the City and DBS Constructors, dba MK Constructors, for the 9th Street Paving and Drainage Improvements Project from Williams Avenue to Duff Drive and along Duff Drive south of 9th Street, in the amount of $679,545.00, referenced to as Exhibit `B", a full copy of which is available for review in the City Secretary's office; and, THAT, the project will be funded by GLO Project No. I219TH, Account No. 144-1201-532.59-00, subject to a budget adjustment within the GLO Program funds, and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
