RESOLUTION NO.
A RESOLUTION AMENDING RESOLUTION NO. 13-227, AS IT PERTAINS TO
POLICIES AND PROCEDURES FOR THE CITY OF PORT ARTHUR TRANSIT
DEPARTMENT AS IT RELATES TO THE HEALTH AND SAFETY OF THE
CITIZENS OF PORT ARTHUR.
WHEREAS,per Resolution No. 13-327, dated July 22, 2013, and pursuant
to Public Law 112-141, (MAP-21), policies need to be updated or created to cover
Sensitivity Training for the Americans with Disabilities Act (ADA) concerning
Trip Denials/Refusal, Safety and Security, and Public Hearing matters; and,
WHEREAS, in accordance to the rules and regulations set forth by the Federal
Transit Administration (FTA), Title 49, Chapter 53, Section 5332 of the United States Code of
Federal Regulations, and the FTA's Circular 4702.1A, Port Arthur Transit, "may deny service to
a person who poses a potential public health threat"; and,
WHEREAS, if the passenger insists that they must ride even though posing a potential
health risk to others, "the driver must call his/her supervisor before continuing or refusing
service to the individual"; and,
WHEREAS, if the supervisor determines that, "a potential threat to public health is
imminent, the trip will be cancelled and service will be denied".

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF PORT ARTHUR:
THAT, Resolution No. 13-327 regarding Policies and Procedures for the City of Port
Arthur Transit Department as it relates to the Health and Safety of the citizens of Port
Arthur is hereby amended to provide the following change; "deny service to a person who poses
a potential public health threat".
THAT, Exhibit`B"to Resolution No. 13-327 be amended to reflect the
aforementioned language.
THAT,the facts and opinions in the preamble are true and correct in accordance to the
rules and regulations set forth in the Code of Federal Regulations (CFR), and the FTA's
Circular 4702.1A.
THAT,the City Council hereby approves the addendum to the Policies and Procedures
for the Port Arthur Transit Department relating to the Health and Safety of the citizens of Port
Arthur.
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
