Comeaux, P.E., Interim City Manager From: Deborah Echols, Director of Finance Date: September 23, 2014 Re: PR 18623 Recommendation I recommend that the City Council approve Proposed Resolution 18623, approving a contract between the City and the Southeast Texas Arts Council (SETAC) for the purpose of funding SETAC programs for the 2014-2015 fiscal year, in the not-to- exceed amount of$45,000. Background The City has provided funding in the amount of $45,000 per year for SETAC for the past several years. This funding, along with funding from other cities, corporations and other agencies provides the operating budget of SETAC. Budgetary Effect Funds were approved in the 2014-2015 budget to provide for the $45,000 support of SETAC, account 140-1405-551.59-00, Project M97901. P. R. NO. 18623 DHE 10/6/14 RESOLUTION NO. A RESOLUTION APPROVING A CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND SOUTHEAST TEXAS ARTS COUNCIL (SETAC) FOR THE PURPOSE OF FUNDING SETAC FOR THE 2014-2015 FISCAL YEAR, IN THE NOT-TO-EXCEED AMOUNT OF $45,000.00. HOTEL OCCUPANCY TAX ACCOUNT NO. 140-1405-551.59-00,M97901. WHEREAS, the City Council recognizes that the Southeast Texas Arts Council provides valuable programs in the community and serves a valid public purpose; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager is authorized to execute the contract attached hereto as Exhibit "A" on behalf of the City of Port Arthur with Southeast Texas Arts Council providing funding for a portion of the operating budget of SETAC; and THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council. Comeaux, P.E., Interim City Manager APPROVED AS TO AVAILABILITY OF FUNDS: Altddine/ Deborah Echols, Finance Director Exhibit "A" THE STATE OF TEXAS * KNOW ALL MEN BY THESE PRESENTS; COUNTY OF JEFFERSON * AGREEMENT THIS AGREEMENT, made and entered into at Port Arthur, Jefferson County, Texas, between the SOUTHEAST TEXAS ARTS COUNCIL (SETAC), non-profit corporation and the CITY OF PORT ARTHUR, TEXAS (the City), a municipal corporation; and WITNESSETH: WHEREAS, SETAC provides support to various cultural activities in the community; and WHEREAS, the City, in recognizing the importance of said activities and the benefits to be derived therefrom by patrons of the arts, the students, and the citizens of the City; and WHEREAS, the City has agreed to provide operating funds for the SETAC for the 2014-2015 fiscal year in a sum not to exceed $45,000, said appropriation having been included in the City budget for the 2014-2015 fiscal year; and NOW THEREFORE, in consideration of the mutual promises, covenants and agreements herein set forth, it is agreed between the parties as follows: THAT, the City agrees to fund the SETAC a sum not-to-exceed $45,000 for the 2014-2015 fiscal year(October 1, 2014 through September 30, 2015). THAT, SETAC shall keep books of account on all expenses and revenues and shall submit a financial report to the City reflecting all receipts and disbursements by SETAC.
