BACKGROUND:
The Zoning Board of Adjustment is being asked to consider a variance request for the
following:

Purpose of Variance: Hurricane IKE Disaster Recovery Program - Round 2.
On Monday, October 13, 2014, forty-two (42) notices were mailed to adjacent property
owners within a 200 ft. radius and the public notice was published in the Port Arthur News
on Sunday, October 5, 2014, more than ten (10) days prior to the ZBA public hearing
scheduled for October 23, 2014.

RECOMMENDATION:
Planning Staff recommends approval of this request, due to an unnecessary hardship. The
proposed structure will fit on the property with the required setbacks. The granting of a
variance will allow for a deviation from the required 50 ft. frontage stipulated in a single
family zoned district to 40 ft. allowing the property owner to rebuild on this legally non-
conforming lot.

BACKGROUND:
The Zoning Board of Adjustment is being asked to consider a variance request for the
following:
Property Address: 2555 95th Street, Port Arthur, TX 77640
Property Location: northwest of 95th Street and west of El Paso Avenue.
Current Lot Size: 18.919 acres
Minimum Required Lot 50' X 100' (Width/Depth)

Variance Requested For: requirement: 744 spaces required(2 spaces per unit)

Purpose of Variance: Requesting relief from the 2 parking space require-
ment for each rental unit: 735 vs. 744 required.

considers the request to be valid.
The zoning ordinance requires 2 parking spaces per rental unit to allow for two people,
each with a car, to have enough space for their vehicles; however, many of the apartments
have only one bedroom and provide less than 900 square feet per unit. Some units are
smaller than 600 square feet, which barely allow enough space for two or more residents.
As such, we feel that the 9-space deficiency will not create a negative effect on complex
residents.

Roll Call-Chairman,George Boutte,Jr.convened the meeting at 5:30 p.m.
Commissioners present: Deral Segler,Freddie Earl and John Clayton were present to constitute
the necessary quorum.
Staff Members present:Ronald Burton,planning director,Paul Brown,senior planner and
Pamela Langford,administrative aide

A. 1314-07 - VARIANCE REQUESTED FOR - 1400 14TH STREET [A.K.A. LOT 10, BLOCK 396,
CITY OF PORT ARTHUR ADDITION], CITY OF PORT ARTHUR, JEFFERSON COUNTY. TEXAS
(PROPERTY LOCATED ON THE SOUTHEAST CORNER OF 14TH STREET AND NASHVILLE
AVENUE).
Chairman Boutte introduced the above-mentioned variance request.
Ronald Burton gave an overview of the above-mentioned request.
