Comeaux, P.E., Interim City Manager FROM: Susan Polka, P.E., Public Works Director/City Engineer DATE: May 14, 2014 RE: Proposed Resolution No. 18661 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18661 that would authorize the Interim City Manager to execute Change Order No. 1 to the contract with Excavators & Constructors, LTD., for construction of street paving and drainage improvements along 5th Street between DeQueen Boulevard and 6th Avenue, extending the time of said contract by four (4) calendar days. BACKGROUND By Resolution 14-294 dated July 8, 2014, the City Council awarded a contract to Excavators & Constructors, LTD., of Port Arthur, Texas, in the amount of $1,991,853.25, for the construction of street paving and drainage improvements along 5th Street between DeQueen Boulevard and 6th Avenue. The contract time per the contract was 270 calendar days, with the Notice to Proceed being August 13, 2014. Work on the storm sewer installation is approximately 15% complete. The purchase order issued for the project states a completion date of May 9, 2015. Excavators & Constructors has requested a time extension due to weather conditions, and has supplied documentation for that request. The project engineer, Arceneaux Wilson & Cole LLC, has verified the documentation and has determined that four (4) calendars should be added to the contract time. The new completion date by the addition of the four (4) calendars days approved would be May 13, 2014. BUDGET/FISCAL EFFECT There is no change in the contract amount as a result of Change Order No. 1, though Purchase Order No. 186426 will need to be amended to reflect the new ending date of the contract. SUMMARY I recommend that the City Council approve Proposed Resolution No. 18661 that would authorize the Interim City Manager to execute Change Order No. 1 to the construction contract with Excavators & Constructors, LTD., for a time extension to the contract by four (4) calendar days to May 13, 2015. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND EXCAVATORS & CONSTRUCTORS, LTD., OF PORT ARTHUR, TEXAS, FOR THE CONSTRUCTION OF STREET PAVING AND DRAINAGE IMPROVEMENTS ALONG 5T11 STREET, INCREASING THE TIME OF THE CONTRACT BY FOUR (4) CALENDAR DAYS, TO A NEW TERM OF 274 CALENDAR DAYS,AT NO ADDITIONAL COST. WHEREAS,per Resolution No. 14-294, the City Council awarded a contract for the construction of street paving and drainage improvements to 5th Street from DeQueen Boulevard to 6th Avenue to Excavators & Constructors, LTD., of Nederland, Texas; and, WHEREAS,the construction of storm sewer improvements began on August 13, 2014, with a contract time of 270 calendar days and an ending date of May 9, 2015; and, WHEREAS, the purchase order issued for the project has a completion date of May 9, 2015; and, WHEREAS,Excavators & Constructors, LTD.,had requested a time extension of four (4) calendars days to their contract for rain conditions during the construction period; and, WHEREAS, our project engineer, Arceneaux Wilson& Cole LLC, has examined the request and recommends proposed Change Order No. 1 in the amount of four(4) calendar days to be added to the contract time for Excavators & Constructors, LTD., said Change Order No. 1 being attached as Exhibit"A": and, WHEREAS, the new ending date for Excavators & Constructors, LTD.'s contract would be May 13, 2015, if the Change Order is approved; NOW THEREFORE, P.R. No. 18661 10/20/14 sjp Page 2 of 3 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the Interim City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 1, attached as Exhibit "A", to the contract between the City of Port Arthur and Excavators & Constructors, LTD., for the extension of said contract by four(4) calendar days, with the new ending date of the contract being May 13, 2015; and, THAT,Change Order No. 1 does not increase the contract amount; and, THAT,a copy of the caption of this resolution be spread upon the minutes of the City Council.
