A RESOLUTION AWARDING A CONTRACT FOR THE IMPROVEMENTS TO LINCOLN PARK, MONTROSE PARK AND LYON'S PARK TO SETEX CONSTRUCTION CORP OF BEAUMONT, TEXAS, IN AN AMOUNT NOT-TO-EXCEED $410,000.00; FUNDS AVAILABLE IN ACCOUNT NO. 120-1429- 582.59-05 ED 1304 AND PARKS ACCOUNT NO. 001-1207-531.39-00 WHEREAS, on September 17, 2014, competitive sealed bids were opened from companies submitting bids for the improvements to Lincoln Park, Montrose Park and Lyon's Park, as designated in the bid packet, attached hereto as Exhibit"A"; and, WHEREAS, SeTEX Construction Corp. of Beaumont, Texas submitted the lowest and most responsive bid in the amount of$410,000.00, as delineated in the tabulation bid sheet, attached hereto as Exhibit`B"; and, WHEREAS, The LaBiche Architectural Group, Inc. examined the bids and determined that SeTEX Construction Corp. of Beaumont, Texas, is the lowest and most responsive bidder, attached hereto as Exhibit"C"; and, WHEREAS, the City of Port Arthur desires to enter into a contract with SeTEX Construction Corp. of Beaumont, Texas, in substantially the same form as attached hereto as Exhibit "D", for the improvements to Lincoln Park, Montrose Park and Lyon's Park; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby awards the contract for the improvements of Lincoln Park, Montrose Park and Lyon's Park to the lowest and most responsible bidder, in accordance with Exhibit `B", SeTEX Construction Corp of Beaumont, Texas, in an amount not to exceed $410,000.00. P. R. # 18597 09/22/14 ca Section 3. That the City Manager is hereby authorized and directed to execute on behalf of the City of Port Arthur a contract, in substantially the same form attached hereto as Exhibit "D", between the City of Port Arthur and SeTEX Construction Corp. of Beaumont, Texas, for the contract price of $410,000.00 for the improvements of Lincoln Park, Montrose Park and Lyon's Park. Section 4. That said contract shall be final upon review and approval of the City Manager, City Attorney and Director of Parks and Recreation, and they are hereby authorized to correct any deficiencies therein. Section 5. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
