The property is located south of 22nd Street, west of 7th Avenue and north of the KCS track. The property is currently located in a Heavy Commercial Zoned District, but the property owners want to operate a Wrecking or Auto Salvage Yard, which is only allowed in an Industrial Zoned District. The abutting zoning designations are: Single Family (SF) to the north, south and east, and Heavy Commercial (HC) to the west. The purpose of this request is to establish a Wrecking or Auto Salvage Yard that would include the crushing of cars by mobile car crushing equipment brought onto the site once or twice a month. On Wednesday, November 5, 2014, twenty-three (23) notices were mailed to adjacent property owners within a 200 ft. radius and the notice was published in the Port Arthur News on Sunday, November 2, 2014; more than ten (10) days prior to the P&Z public hearing scheduled November 17, 2014. Owner/Applicant-Kenneth J. Mitchell RECOMMENDATION: The Planning staff recommends that this request be approved with certain restrictions put in place that would only allow the property to be used for a Wrecking and Auto Salvage Yard and no other industrial district-only use. In addition, car crushing activities will be allowed only one day a month by use of mobile car crushing equipment trucked onto the site by a semi-tractor trailer. Also, the salvage yard will not be open to the general public as a retail salvaged parts outlet; instead, the salvaged parts shall be trucked from the site for wholesale elsewhere. The site will also not be used to buy metals for recycling from either businesses or the general public. The operators shall take all efforts to protect the ground, air and water from pollution from any business activities or auto wrecking or salvage use. The property must be enclosed by a screening fence meeting the requirements stated in City Code Section 18-457 (b) reproduced completely here: Wrecking or auto salvage yard. No person shall erect, construct, maintain, or cause or permit to be erected, constructed, or maintained, any junkyard, automobile wrecking or salvage yard, or any premises described under article IV, junk and junk dealers, of chapter 22, businesses, unless such junkyard, automobile or salvage yard, or other premises shall be completely enclosed by a closed fence not less than eight feet in height; constructed, in conformance with city standards, of wood, stone, brick, concrete block or other permanent material; having a completely solid area with no openings; and permanently maintained. Currently, the property gate is constructed of corrugated sheet metal, which is not allowed under the preceding section of code. The operators must bring the gate into compliance immediately regardless the Commission's recommendation and the wooden fence must meet the minimum 8-foot height requirement.
