I recommend that the City Council adopt Proposed Resolution 18786 which authorizes a contract
between the City of Port Arthur and Mitchell Fontenote for the provision of Accounting services
for the Finance Department account no. 001-1032-515.54-00, and an increase in the existing
blanket purchase order in the amount of$10,000.00.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT
BETWEEN THE CITY OF PORT ARTHUR AND MITCHELL
FONTENOTE, CPA, FOR THE PROVISION OF ACCOUNTING
SERVICES FOR THE FINANCE DEPARTMENT IN AN AMOUNT NOT
TO EXCEED $35,000.00, AND INCREASING THE BLANKET PURCHASE
ORDER FOR THE EXISTING CONTRACT BY $10,000.00. FUNDING
AVAILABLE IN FINANCE ACCOUNT NO. 001-1032-515.54-00.
WHEREAS, pursuant to Resolution 14-048, the City entered into an agreement with
Mitchell T. Fontenote, (consultant) CPA to render professional accounting assistance; and
WHEREAS,the City of Port Arthur Accounting Division lost both professional
accountants,the Comptroller and the Accountant, in June 2014, thereby causing additional work
to be performed by the consultant; and
WHEREAS, it is necessary to increase the blanket purchase order for the existing
contract to include additional work performed by the consultant in the amount of$10,000.00;
and
WHEREAS, Mr. Fontenote's contract expires on February 3, 2015, and the City of Port
Arthur Accounting Division is still in need of professional assistance at this time; and
WHEREAS,the Finance Department wishes to contract with Mitchell Fontenote, CPA,
who has agreed to provide professional services at a rate of$150.00 per hour.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the City Council hereby authorizes the existing Blanket Purchase
Order to be increased by $10,000.00 for the additional work performed by the consultant.
Section 2. That the City Manager is hereby authorized to execute a contract between
the City of Port Arthur and Mitchell Fontenote, CPA, in substantially the same form as attached
hereto as Exhibit"A".
Section 3. That a copy of the caption of this Resolution be spread upon the Minutes
of the City Council.

EXHIBIT "A"
AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES
This agreement is made between the City of Port Arthur, Texas hereinafter referred to as "City"
and Mitchell Fontenote, CPA, a person licensed to practice as a Certified Public Accountant.
I. TERM OF AGREEMENT
This Agreement shall be for a one year period from the date stated in the notice to proceed.
Thereafter,this Agreement shall be renewable at the discretion of the parties.
II. PROFESSIONAL SERVICES
Mr. Mitchell Fontenote, CPA, will be considered an independent contractor for the City of Port
Arthur and shall provide accounting services for the City's Finance Department. Such services
shall be at the standard of care/knowledge expected of accountants in Texas.
III. COMPENSATION
Mr. Mitchell Fontenote, CPA shall be paid One Hundred Fifty Dollars ($150)per hour for
accounting services actually rendered. The hours of work shall be mutually agreed upon by the
Finance Director of the City of Port Arthur and Mr. Mitchell Fontenote, CPA.
IV. LICENSURE
Mr. Mitchell Fontenote, CPA shall maintain and provide proof of license with the State Board of
Public Accountants. Failure to maintain licensure will immediately render this contract null and
void.
V. BENEFITS
All benefits result from this contract are delineated herein, and no other benefits promise by any
City office shall be binding on the City.
VI. TERMINATION
This Agreement can be terminated with fourteen(14) days prior written notice by either party.
