RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A
MEMORANDUM OF UNDERSTANDING WITH LAMAR STATE COLLEGE PORT
ARTHUR
WHEREAS, the City Council of the City of Port Arthur deems the
economic and educational welfare of its citizens a primary concern; and,
WHEREAS, the City desires to promote access to job skill enhancing
and educational development opportunities in a cost effective and efficient
manner; and,
WHEREAS, Lamar State College Port Arthur is an academic unit of
the Texas State University System and a long time educational resource
of the community and region; and,
WHEREAS, the provision of this assistance to Lamar State College
Port Arthur would fulfill the key oses p ublic purposes of increasing,P p g,
enhancing, the employability of Port Arthur citizens as well as the
marketability of the city as a workforce provider for businesses and
corporations; and,
WHEREAS, it is deemed in the best interest of the citizens of Port
Arthur to enter into a Memorandum of Understanding with Lamar State
College Port Arthur to partner in, and assist with, the college's new

Commercial Driver's License B program to afford residents the
opportunity for educational attainment and job skill enhancing training;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS:
Section 1: That the facts and opinions of the preamble are
true and correct.
Section 2: That the City Manager is hereby authorized to execute
the Memorandum of Understanding which is shown as
Exhibit "A" hereto.
Section 3. That a copy of the caption of the Resolution be
spread upon the Minutes of the City Council.
READ, ADOPTED, and APPROVED this day of A.D.,
2014, at a Meeting of the City Council of the City of Port
Arthur, Texas, by the following vote:

BETWEEN
The City of Port Arthur, Texas
AND
Lamar State College Port Arthur
WHEREAS, the economic and educational welfare of the
citizens of Port Arthur is a key concern of the City Council of
the City of Port Arthur and directly linked to its quality of
life focus; and,
WHEREAS, the City Council of the City of Port Arthur deems
access to educational attainment and job skill enhancing
training an issue of grave import even as reflected in dialog at
the national level; and,
WHEREAS, Lamar State College Port Arthur is a unit of the
Texas State University System and long time educational resource
of the community and region; and,
WHEREAS, the City deems it reasonable, prudent, and
desirable to partner with Lamar State College Port Arthur in its
endeavors to provide access to educational opportunities and job
enhancing skill training to citizens of Port Arthur; now,
therefore,
BE IT RESOLVED
THAT: This Memorandum of Understanding is hereby authorized,
and agreed to, between the City of Port Arthur, Texas
["The City"] and Lamar State College Port Arthur.
["LSCPA"] .
THAT: The City deems it a public purpose to increase, and
enhance, the employability of citizens, as well as
increasing and enhancing the marketability of the city
as a workforce provider for corporations and
businesses.
THAT: The City will provide appropriate for Class B CDL
training dump trucks and similar vehicles for program
use subject to the following:
A. The City will be added as an additional insured
on the college' s insurance relative to those
vehicles used.

B. Vehicles will be provided based on
availability.
C. Training will be conducted by properly licensed
individuals with preference given to City
employees hired as adjunct instructors.
D. Vehicles will be inspected upon arrival and
conclusion of training periods .
E. The City assumes no liability for City
employees hired as adjunct instructors .
F. The City assumes no liability for City vehicles
used in the training program,
THAT: The City will provide said vehicles for use in the
program at no cost to the college.
THAT: City fully supports the college in its endeavor to
provide quality education and employment eligibility
enhancing programs.
THAT: This Memorandum of Understanding represents the
entirety of the agreement between the named parties
and may be amended by mutual written consent executed
by the signatories hereto or their successors .
THAT: This Memorandum of Understanding will remain in full
force and effect unless one party notifies the other
of the desire to terminate this agreement in writing.
Said written notice of termination must be given
thirty (30) days prior to the desired termination
date.
THAT: This Memorandum of Understanding shall become
effective upon the date of signature of the last
signatory hereto.

Re: City vehicles to be used by. Lunar State College Port Arthur in its new
Commercial Driver's License Course.

"Phis is a note to memorialize the conversation we had together at your orrice on 11 November 2011 and to turn
our discussion points into a formal request from the College to the City.
Lamar State College Port Arthur is interested in creating a new commercial driver's license (CDL)course
beginning late in January of 2015. All students%ill attend three-weeks of classroom training and must pass the
C1)I.written test in order to achieve their learner's permit before being allowed to proceed to the driving portion
of the training. The new course will not use driving simulators and students will be provided hads-on
experience in(Irlvnng and conducting the safely inspections of industrial vehicles and busses.
The College seeks to oiler a course specifically designed to provide students with the training needed to step out
to the classroom and into any of the City's fleet of vehicles with confidence. In order to achieve this goal the
College asks to be allowed to use the Hollowing City vehicles for training purposes:
1. A city bus,
2. A city clump truck,and
3. A city fuel truck.
The use of these vehicles will allow tlhe College io 14niliarize students with the vehicle;commonly in use in the
City's departments and also allow us to demonstrate aspects of the vehicles as we train for the passenger, school
bus and lnazmat endorsements uttered with the Class B license.
The vehicles would be in use from roughly 5:30 pm to 8:00 pen three nights per week. Vehicles may also he
scheduled for use on weekends with approval from the City. The classes will be 12 weeks in length and will be
offered three times per year with time oft-during the holiday season. City vehicles will also be scheduled Ibr
student driving examinations.

In addition to using City vehicles. the College would like fo r the City t<)recommend several employees who
already drive for the City. Some of these drivers will be hired by the College as adjunct instructors and used to
assist the lead teacher assigned to the class.The College proposes to use assistant teachers in each vehicle. These
teachers will bring the vehicles from tl►e City to the College for scheduled classes and return the vehicle to the City
when the class ends. Assistant teachers will remain with their vehicles and will supervise student's use of the
vehicles. In any instance where a student is in a vehicle either the assistant teacher or the lead teacher will he in
the vehicle as well,
While vehicles are in use by the College.the College will cover both vehicles and drivers under their insurance for
damage.The College will also provide the gasoline for its use of the vehicles.
If the Cite is in agreement xvitll the project as outlined in this letter I ask that the City proceed to forward a list of
nmuncs and contact information for potential assistault drivers and also proceeds to target vehicles which can be
used by the College in the new year.
