Subject: P. R. No. 14137; Council Meeting of June 19,
2007
Attached is P. R. No. 14137 calling for a public
hearing to be set for August 19, 2007 as to receive input on the
continued use of Section 4A Sales and Use Tax within the City for
amateur sports, and athletic purposes and events. The funds were
approved at the May 13, 2006 Election by Proposition 8. The
funds were approved for a two year period. The total funds for
Section 4B projects could not exceed $500,000 per year. Said
period of time can be extended an additional two years by the
City Council by a ~ vote of the City Council after receiving
public comment of the proposed cost and impact of the projects.
Therefore, the existing funding will end in May 2008 and could
have an impact on the budget for the Fiscal Year from October 1,
2007 to September 30, 2008. Therefore, I would recommend a
public hearing be held and that this matter be considered prior
to October 1, 2007.

RESOLUTION NO.
A RESOLUTION CALLING FOR A PUBLIC HEARING AS
TO RECEIVE INPUT ON THE CONTINUED USE OF
SECTION 4A SALES AND USE TAX WITHIN THE CITY
OF PORT ARTHUR FOR AMATEUR SPORTS, AND
ATHLETIC PURPOSES AND EVENTS (PROPOSITION 8)
WHEREAS, at the May 13, 2006 Election, the voters approved
Proposition 8, as described in Exhibit "A" attached hereto, which
stated that for the next two (2) years, the existing Section 4A
sales and use tax within the City of Port Arthur will be utilized
for amateur sports, and athletic purposes and events, including
ball parks, soccer fields, football fields, and related concession,
and facilities, which is a category of projects under Section 4B of
Article 5190.6 Vernon's Texas Code Statutes, with the condition
that total annual spending on all Section 4B projects by the City
of Port Arthur Section 4A Economic Development Corporation will not
exceed $500,000 per year; and
WHEREAS, said Proposition 8 also stated that said period of
time can be extended an additional two years by the City Council by
a 2/3 vote of the City Council after receiving public comment of
the proposed cost and impact of the projects; and
WHEREAS, it is deemed in the best interest of the citizens to
call for a public hearing as to the continued use for an additional
two years of Section 4A sales and use tax within the City of Port
Arthur being utilized for amateur sports, and athletic purposes and

events, including ball parks, soccer fields, football fields, and
related concession, and facilities, which is a category of projects
under Section 4B of Article 5190.6 Vernon's Texas Code Statutes,
with the condition that total annual spending on all Section 4A
Economic Development Corporation will not exceed $500,000 per year
until May 13, 2010.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
That the facts and opinions in the preamble are
