July 17, 2007 Page I of 1 RECOMMENDATION: The Fire Department recommends that the City Council approve the purchase of ten (10) Level A Fully Encapsulated Haz-Mat Suits from TriCon Environmental of Auburn, Alabama in the amount of $8,955.89. BACKGROUND: This Fire Department equipment will be utilized at hazardous materials incidents involving spills or leaks. The Fire Department received the following quotes: Vendor Cost TriCon Environmental, of Auburn AL $8,955.89 Dooley Tackaberry, of Deer Park, TX $8,980.60 Hagemeyer of Charleston, SC $9434.13 BUDGET/FISCAL EFFECT: Funds are available in Account Number 107-1118-521.92-00, Project # PS 0007 for this purchase. This purchase is 100% funded by 2006 Homeland Security Grant Program approved by City Council at the October 24, 2006 Council meeting. STAFFING/EMPLOYEE EFFECT: None SUMMARY: The Fire Department recommends the City Council to approve the purchase of ten (10) Level A Fully Encapsulated Haz-Mat Suits from TriCon Environmental, Inc., of Auburn, Alabama in the amount of 8,955.89. The price of $8,955.89 is the lowest most responsible bid. LARRY D. BACKGROUND: This Fire Department equipment will be utilized at hazardous materials incidents involving spills or leaks. The Fire Department received the following quotes: Vendor Cost Dooley Tackaberry, of Deer Park, TX $8,980.60 TriCon Environmental, of Auburn AL $8,955.89'* Hagemeyer of Charleston, SC $9434.13 Due to the Reciprocity Texas Government Code 10 Subtitle D, Section 2252, the Purchasing Division reconunends awarding the bid to Dooley Tackaben~y of Deer Park, Texas in the amount of $8,980.60. Texas Code Annotated, Government Code Annotated, Title 10, Subtitle D, & 252.002(Lexis 2000) Reciprocal preference in favor of Texas businesses for all governmental contracts. Reciprocity is defined as the response in like kind. Texas Government Code, Title 10, Subtitle D Section 2252 states that grant resident bidder preference for that state's purchases must be reciprocated in the same manner when bidding against a Texas bidder. In other words, the State of Texas will respond in kind or reciprocate to preferences made by other states. Example: Another state gives its in-state bidders a 5% advantage on a certain commodity. In effect, this would penalize a Texas bidder 5% when bidding in that state. ConsequentlyT we would add the same 5% penalty to any of those states' bidders when bidding in Texas for the same commodity or service. Code of Alabama, Title 41, & 41-16-20 (2000 Al. $.B. 260) - With the exception of public works contracts, a five percent (5%) preference is applied in all contracts of whatever nature for labor, services, work, or for the purchase or lease of materials, equipment, supplies, or other personal property, involving seven thousand five hundred dollars ($7,500) or more to a person, finn or corporation.
