RE: P.R. No. 18611 — Appointing and/or Reappointing members and alternates to
the Zoning Board of Adjustment (ZBA)
COMMENT:
RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution 18611 appointing
and/or reappointing members and alternates to the Zoning Board of Adjustment (ZBA) to
serve a two (2) year term.
BACKGROUND:
In accordance with Section 211.008 of the Texas Local Government Code and Section 25-
100 of the Zoning Ordinance of the City of Port Arthur, Texas, the Mayor with the approval
of the City Council may appoint members to the Zoning Board of Adjustment (ZBA) for a
term of two years.
BUDGETARY EFFECT: None
STAFFING/EMPLOYEE EFFECT: None
SUMMARY:
It is recommended that the City Council approve Proposed Resolution 18611 appointing

RESOLUTION NO.
A RESOLUTION APPOINTING AND/OR REAPPOINTING MEMBERS
AND ALTERNATES TO THE ZONING BOARD OF ADJUSTMENT AND
PRESCRIBING THE TERM OF OFFICE.
WHEREAS, pursuant to Section 211.008 of the Texas Local Government Code and Section
25-100 of the Zoning Ordinance of the City of Port Arthur, Texas, the Mayor with the approval of
the City Council may appoint members to the Zoning Board of Adjustment for a term of two
years; and,
WHEREAS, the Zoning Board of Adjustment primary function is to deal administratively
with individual and neighborhood zoning decisions on a tract-by-tract basis; and,
WHEREAS, membership on the Zoning Board of Adjustment is set at five (5) members and
up to four (4) alternates; and,
WHEREAS, the current board member and alternate positions expired in 2014; and,
WHEREAS, there is a need to appoint five (5) members to the five (5) positions on the
board and four (4) members to the four alternate positions on the boards; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1. That the facts and opinion in the preamble are true and correct.
Section 2. That new members and alternates are hereby appointed to the Zoning Board of
Adjustment, as shown on the attached Exhibit "A", and shall serve two (2) year terms.

Section 3. That any or all of the four (4) nominees as alternates can act in the absence of
the members, which in turn will allow the Zoning Board of Adjustment to operate in compliance
with all of Sections 25-200 through 25-203 of the Zoning Ordinance.
Section 4. That a quorum shall be obtained for the scheduled meetings, in accordance
with Chapter 211 of the Texas Local Government Code and Chapter 551 Government Code.
Section 5. That new members and alternates, upon taking the required oath of office and
doing all things necessary to qualify for such office, shall have all the rights and powers provided
by the Statutes and Ordinances pertaining thereto appertaining.
Section 6. That in accordance with Resolution No. 98-157, the appointee shall immediately
contact the City Secretary and be sworn in, receive a copy of the Charter and the Zoning
Ordinance, and attend an orientation seminar from the City Attorney's office.
Section 7. That a copy of this Resolution be spread upon the Minutes of the City Council.
READ, ADOPTED AND APPROVED this the day of February, A.D., 2015, at a
Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: AYES:

List of Candidates
Mr.Anthony Leger
Owner/Partner and Vice-President of Soutex Surveyors and Engineers who manages and directs all commercial,
residential, industrial and municipal Engineering and Surveying Projects for the company. He has 30 years'
experience in the surveying and engineering field and has worked for the City of Beaumont Engineering
Department as a Construction Inspector II, Faust Engineering and Surveying as a Supervisor of Operations and
Scheduling, and has owned and operated Soutex Surveyors and Engineers since 1996.
Mr.Antoine Freeman
A graduate of Abraham Lincoln High School; has a B.S. from Texas College in 1995 and secured a Juris Doctorate
from the University of Tulsa in 2005.
Mr.Gregory Casmire
Retired from the Texas Department of Transportation in Beaumont, Texas after 29 years of service, he is also an
Engineer EIT.
Mr. Dihn Nguyen
Owner of LLB Construction. Has built a total of nine (9) homes in the City of Port Arthur and also reconstructed
the second floor of City Hall.
William V. Larrain,P.E., Project Engineer, Owner
Mr. Larrain is a registered professional engineer in Texas and a graduate from the University of Houston. Mr.
Larrain started Action Civil Engineers following an eleven (11) year transition, since his gaining ownership of
d.p. Consulting Engineers. Mr. Larrain had been with d.p. Consulting Engineers, Inc. for 18 years, since 1997
following 10 years as the Director of Utility Operations for the city of Port Arthur. Mr. Larrain spent 11 years
prior to his experience in City Government with another civil consulting firm in Jefferson County.
Mr. Larrain has over thirty-nine (39) years of experience in project engineering, engineering and construction
management, and public utility operations. Experience has been diverse ranging from design and analysis of
wastewater treatment, pumping and collection systems; potable water pumping, distribution and storage
facilities; flexible base and concrete roadway design; storm sewer conveyance systems and area drainage
studies. Other activities include experience in obtaining and managing state and federal grants, preparing
engineering reports for the creation of special purpose districts, state and federal wastewater discharge
permitting, and the preparation of operation and maintenance manuals.
