MEMORANDUM CITY OF PORT ARTHUR PUBLIC WORKS - ENGINEERING DIVISION TO: Brian McDougal, City Manager FROM: Susan Polka, P.E., Public Works Director/City EngineerL,P DATE: January 27, 2015 RE: Proposed Resolution No. 18772 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18772 that would authorize the City Manager to execute Change Order No. 1 to the contract with McInnis Construction, Inc., for construction of street paving and drainage improvements along 18th Street between Fort Worth Avenue and Stillwell Boulevard, extending the time of said contract by twenty-one (21) calendar days. BACKGROUND By Resolution 14-311 dated July 22, 2014, the City Council awarded a contract to McInnis Construction, Inc., of Silsbee, Texas, in the amount of $2,781,583.85, for the construction of street paving and drainage improvements along 18th Street between Fort Worth Avenue and Stillwell Boulevard. The contract time per the contract was 270 calendar days, with the Notice to Proceed being October 1, 2014. Work on the storm sewer installation is approximately 5% complete. The purchase order issued for the project states a completion date of June 27, 2015. McInnis Construction, Inc. has requested a time extension due to the location, condition and type of water main pipe that is located in 18th Street but was not shown on the plans, and has supplied documentation for that request. The project engineer, Arceneaux Wilson & Cole LLC, has verified the documentation and has determined that twenty-one (21) calendars should be added to the contract time at the present time. Additional time may be requested under a future change order. The new completion date by the addition of the twenty-one (21) calendars days approved would be July 18, 2015. BUDGET/FISCAL EFFECT There is no change in the contract amount as a result of Change Order No. 1, though Purchase Order No. 186699 will need to be amended to reflect the new ending date of the contract. SUMMARY I recommend that the City Council approve Proposed Resolution No. 18772 that would authorize the City Manager to execute Change Order No. 1 to the construction contract with McInnis Construction, Inc., for a time extension to the contract by twenty-one (21) calendar days to July 18, 2015. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND MCINNIS CONSTRUCTION, INC., OF SILSBEE, TEXAS, FOR THE CONSTRUCTION OF STREET PAVING AND DRAINAGE IMPROVEMENTS ALONG 18TH STREET, INCREASING THE TIME OF THE CONTRACT AMOUNT BY TWENTY-ONE (21) CALENDAR DAYS, DUE TO CLOSE PROXIMITY OF EXISTING 24" WATERLINE, TO A NEW TERM OF 291 DAYS, AT NO ADDITIONAL COST. WHEREAS, per Resolution No. 14-311, the City Council awarded a contract for the construction of street paving and drainage improvements to 18th Street from Fort Worth Avenue to Stillwell Boulevard to McInnis Construction, of Silsbee, Texas; and, WHEREAS, the construction of the improvements began on October 1, 2014, with a contract time of 270 calendar days and an ending date of June 27, 2015; and, WHEREAS, the purchase order issued for the project has a completion date of June 27, 2015; and, WHEREAS, McInnis Construction, Inc., had requested a time extension of twenty-one (21) calendars days to their contract for a delay due to close proximity of an existing 24" waterline; and, WHEREAS, the project engineer, Arceneaux Wilson & Cole LLC, has examined the request and recommends proposed Change Order No. 1 in the amount of twenty-one (21) calendar days to be added to the contract time for McInnis Construction, Inc., said Change Order No. 1 being attached as Exhibit"A"; and, WHEREAS, the new ending date for McInnis Construction, Inc.'s contract would be July 18, 2015, if the Change Order is approved; NOW THEREFORE, P.R. No. 18772 1/27/15 sjp Page 2 of 3 BE IT RESOLVED BY THE CITY COUNCIL OF TILE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 1, attached as Exhibit "A", to the contract between the City of Port Arthur and McInnis Construction, Inc., for the extension of said contract by twenty-one (21) calendar days, with the new ending date of the contract being July 18, 2015; and, THAT, Change Order No. 1 does not increase the contract amount; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council. This change order is a time extension of 21 days due to the contractor being delayed because of close proximity to an existing 24" waterline. At a request by the City of Port Arthur the contractor was delayed further work until the location, condition and type of pipe of an existing 24" waterline was determined. I recommend that the City of Port Arthur authorize this change to the contract.
