A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NOS. 1 AND 2 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND APAC-TEXAS, INC., OF BEAUMONT, TEXAS, FOR THE PLEASURE ISLAND MARINA PAVING REHABILITATION, INCREASING THE CONTRACT AMOUNT BY $4,966.88, TO A NEW TOTAL OF $410,255.88, AND THE TIME OF THE CONTRACT TERM BY EIGHTEEN (18) CALENDAR DAYS, DUE TO WEATHER DELAYS, TO A NEW TERM OF 138 DAYS. FUNDS AVAILABLE IN PLEASURE ISLAND ACCOUNT NO. 450-1293-549.89-00. WHEREAS, per Resolution No. 14-405, the City Council awarded a contract for the Pleasure Island Marina paving rehabilitation project to APAC-Texas, Inc., of Beaumont, Texas; and, WHEREAS, APAC-Texas, Inc. has requested Change Order No. 1 increasing the contract amount by $4,966.88 for additional work items, not included in the original contract, as follows: 1) Install Gate Control Loop (Area #1 — Item 130); 2) Removal of broken concrete at driveway entrance (Area #7 — Item 140); 3) Removal of concrete pad (old boat ramp) (Area #7 — Item 150); 4) ADA (Truncated Domed Panels) (Areas #3, 4 & 7 — Item 170); and 5) Water Valve Boxes (Round Metal) (Areas #3, 4 & 7 — Item 180), see attached Exhibit "A"; and, WHEREAS, APAC-Texas, Inc., has also requested Change Order No. 2 for a time extension of eighteen (18) calendars days due to weather delays, see attached Exhibit "B"; and, s.pr18839 P.R. No. 18839 1/28/15 jd/gt Page 2 of 3 WHEREAS, the project engineer, Soutex Surveyors & Engineers, has examined the requests and recommends proposed Change Order Nos. 1 and 2, attached as Exhibits "A" and "B", respectively. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 1, attached as Exhibit "A", increasing the contract amount by $4,966.88 for additional work not included in the original contract, to a new total of $410,255.88. THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 2, attached as Exhibit "B", to the contract between the City of Port Arthur and APAC-Texas, Inc., for the extension of said contract by eighteen (18) calendar days due to weather delays, to a new term of 138 days, with the new ending date of the contract being March 13, 2015, at no additional cost. THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council. We have reviewed the proposal for additional work items submitted by APAC-Texas, Inc. and found them to be reasonable for an amount of$4,966.88. Attachments Cc: Shawna Tubbs— Purchasing Manager Legal Department Change Order No. 1 This Change Order is for work to be performed on Pleasure Island Paving Project for approval as listed below. Item numbers are listed on APAC-Texas, Inc.'s Proposal. 1. Area#1 (Item 130) --Install Gate Control Loop (4'x8' Preformed).The Existing Loop Control was inserted and sealed with silicone in the small saw cut of the existing asphalt.The dark discoloration of the silicone sealant was the primary reason why the loop was not found nor included in the original design bid items. The Loop was found prior to removal of driveway. 2. Area#7 (Item 140)--Removal of broken Concrete at driveway entrance. The existing broken concrete was to the southwest of the existing gate entrance of Area #7. It was covered with soil and grass and this was the primary reason why the existing broken concrete was not located nor included in the original design bid items. The broken concrete was discovered when grading the new gate location. 3. Area#7 (Item 150) --Removal of Concrete Pad (Old Boat Ramp Pad). The existing concrete pad was near the northeast quadrant of Area #7. The concrete pad was covered with soil and grass and this was the primary reason why the existing concrete pad was not discovered prior to construction nor included in the original design bid items for removal. The concrete pad was discovered when grading the subgrade area in that location. 4. Areas#3,4&7 (Item 170)--ADA(Truncated Domed Panels). In the original plans of the City Sidewalk and Driveway Detail Sheet did not specify which option is preferred (Grooves or Truncated Dome)for this project. The city expressed the desired preference of Truncated Dome. 5. Areas#3,4&7 (Item 180)—Water Valve Boxes(Round Metal). On the project there exist square concrete water meter boxes over the existing water valves to the fire hydrants. These boxes and valves were covered beneath the grass and the existence of these valves and boxes were discovered during the removal of the soil top layer and grass during the process of grading for constructing the ADA sidewalks. The primary reason is due to the existing damaged and/or missing boxes that are in need of replacement. The valves are located in the paths of the proposed ADA sidewalks in these areas. We are requesting an extension for the completion of the project as our Contract due date is approaching. As noted in the attached document, we are requesting an additional 18 calendar days to be added to their Contract, bringing the completion date to March 13, 2015.
