I. INVOCATION, PLEDGE & ROLL CALL
Mayor Pro Tern Freeman gave the invocation followed with the pledge to the flag.
The City Council of the City of Port Arthur met in Special Session on Monday, December
15, 2014 at 9:12 a.m. in the City Council Chamber, City Hall, with the following
members present: Mayor Deloris "Bobbie" Prince; Mayor Pro Tern Freeman;
Councilmembers Raymond Scott, Jr., Stephen A. Mosely, Robert E "Bob" Williamson and
Kaprina Frank; Interim City Manager John A. Comeaux, P.E., City Secretary Sherri
Bellard and City Attorney Valecia Tizeno.
Councilmember Tiffany Hamilton joined the Special Meeting during Executive Session.
Councilmembers Morris Albright, III and Willie "Bae" Lewis, Jr. were absent from the
Special Executive Meeting.
II. *CLOSED MEETING (EXECUTIVE SESSION)
Closed Meeting:
(1) Section 551.072 Government Code — To Discuss The Value
Of The Land In The City's Extraterritorial Jurisdiction (ETJ)
(Premcor Refining Group, Inc./Valero)
(2) Section 551.071 Government Code — To Discuss With The
City Attorney Potential Litigation As It Pertains To
Industrial District Agreements (Premcor Refining Group,
Inc./Valero)
The City Council recessed their meeting at 9:13 a.m. to meet in Executive Session to
consider the above-mentioned topic, and reconvened their meeting at 10:03 a.m. with
the following members present: Mayor Prince; Mayor Pro Tern Freeman;
Councilmembers Scott, Hamilton, Mosely, Williamson and Frank; Interim City Manager
Comeaux; City Secretary Bellard and City Attorney Tizeno.
MOTION IN OPEN SESSION
Councilmember Williamson read the following motion into the record:
A Motion Directing The City Manager And The City Attorney To
Offer An Industrial District Agreement To Premcor Refining
Corporation, Inc. On Similar Terms As The Other Industrial
Agreements Signed By The Other Industries In December Of
2013. Pending The Receipt Of A Fully Executed Industrial District
Agreement Signed By The Proper Authorities And A Check For
Expenses To Be Delivered To The Office Of The City Attorney On
Or Before Thursday, December 18, 2014 At 5:00 P.M.
The motion was made by Councilmember Williamson and seconded by Mayor Pro Tern
Freeman that the above-mentioned motion be adopted.
The following roll call vote was taken on the motion to adopt the above-mentioned
motion:
Mayor Pro Tem Freeman "Yes"
Councilmember Frank "Yes"
Councilmember Hamilton "Yes"
Councilmember Mosely "Yes"
Councilmember Scott "Yes"
Councilmember Williamson "Yes"
Mayor Prince "Yes"
The above-mentioned motion carried.
III. ADJOURNMENT
Upon the motion by Mayor Pro Tem Freeman, seconded by Councilmember Hamilton
and carried unanimously, the City Council adjourned their Special Executive Meeting at
10:05 a.m.
An audio-tape of this meeting is on file in the office of the City Secretary and is made a
part of the official minutes of this meeting.
