A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT WITH BOB SHAW ENGINEERS, OF PORT ARTHUR,
TEXAS FOR DESIGN AND CONSTRUCTION PHASE SERVICES FOR THE
EMERGENCY DESIGN WORK AT THE 3RD AVENUE AND SEAWALL STORM
SEWER AND ADJACENT 36" SANITARY SEWER, INCLUDING LEVEE
REPAIRS IN AN AMOUNT NOT TO EXCEED $73 . 000. 00. FUNDS ARE
AVAILABLE IN SEWER RECONSTRUCTION ACCOUNT NO. 428-1625-
532 . 83-00 . PROJECT NO. 428000
WHEREAS, since November 2014, City staff has been working with
Drainage District 7 to determine the cause of a void that has
developed in the levee at the Seawall and DeQueen Blvd; and,
WHEREAS, the void was traced to an abandoned 36" sanitary
sewer line and the problem appears to be a cross connection with
the abandoned sanitary sewer line and an active 24" sewer line at
3rd Avenue and Seawall; and,
WHEREAS, engineering plans and specifications are needed in
order to complete construction work at both the 3rd Avenue and
DeQueen Blvd. location to repair the sanitary and storm sewer as
well as levee repairs; and,
WHEREAS, Bob Shaw Engineers, of Port Arthur has been
previously working with Drainage District 7 on this matter and is
very familiar with the aspects of this projects; and,
WHEREAS, Bob Shaw Engineers has provided a quote for the
proposed design and construction phase services for the necessary
repairs attached hereto as Exhibit "A" , in a total amount not to
exceed $73 , 000 . 00 .
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:

Section 2 . That in order to protect the health and safety
of our citizens, the City Council hereby authorizes the proposal
from Bob Shaw Engineers for emergency design work located 3rd Avenue
and Seawall, and DeQueen Blvd.
Section 3 . That a copy of the caption of this Resolution
shall be spread upon the Minutes of the City Council .

SUBJECT: Emergency Work at Seawall and 3rd Avenue/DeQueen Areas
COMMENTS
Since November 2014, City staff from the Public Works and Utilities Departments has
been working with Drainage District 7 to determine the cause of a void that has
developed in the levee at the seawall and De Queen Street. The problem was traced to an
abandoned 36" sanitary sewer line that runs adjacent to and underneath the levee. The
source of the problem appears to be a cross connection with the abandoned sanitary sewer
line and an active 24" storm sewer line at 3`d Avenue and the seawall. Engineering plans
and specifications are needed in order to complete construction work at both the 3r1
Avenue and DeQueen Street locations to repair sanitary and storm sewers as well as levee
repairs.
The attached proposal is for design and construction phase services for the necessary
utility and levee repairs. Bob Shaw Engineers of Port Arthur, Texas has provided a quote
for this work in the amount not to exceed $73,000.00. Bob Shaw Engineers has
previously been working with Drainage District 7 to determine the cause of the void in
the levee and is familiar with all aspects of this project.

DeQueen& Vicinity Sewer Repairs

Dear Ms. Polka:
We are pleased to submit this proposal to provide Professional Engineering Services for
the design phase and construction phase services for emergency sewer repair improvements. This
project first came into existence when undermining of the pavement subgrade was observed below
Seawall Drive at DeQueen Boulevard. Interior inspection of the City's underground storm sewers
and box culverts in the general vicinity revealed a large leak coming from the top of a reinforced
concrete junction box. A review of existing City record drawings, DD7 record drawings, and an
on-ground survey of surrounding drainage features show the leak being located where an
abandoned 36" sanitary sewer line that crossed directly over the existing junction box. The
undermining of Seawall Drive is caused by the erosion of the supporting soil being washed away,
into a break in the underground storm sewer system and ultimately into the DeQueen pump station
forebay. A laboratory analysis of the fluid leaking into the junction box confirmed the presence of
fecal coliform, indicating the presence of wastewater. Additional research and field investigation
revealed that an existing manhole on the abandoned 36"sanitary line, in the vicinity of 3`d Avenue
at the Hurricane Flood Protection Levee (HFPL), both contained an active storm sewer line and
an active sanitary line discharging into the manhole. We believe this location is the source of the
wastewater being introduced into the abandoned 36" line and ultimately into the storm sewer
system in the vicinity of DeQueen Blvd. Due to its location with the HFPL and the depth of the
repair, the excavation to resolve this issue will encroach into the clay core of the levee.
Additionally, the sinkhole beneath Seawall Drive has grown rapidly since it was first observed at
the end of last year. In order to minimize additional damage to the levee system, this project has
been elevated to emergency repair status.
The purpose of this Proposal is to provide construction plans and specifications for the
following emergency engineering design services:
3rd Avenue & Vicinity (Area 1)
1. Define the limits and specify a method to plug the existing abandoned 36" sanitary
sewer line located within the DD7/HFPL right of way to isolate it from the existing
active storm sewer(which discharges through DD7 closure structure#19 in the HFPL).

2. Design a solution for the connection/reroute of existing active rear lot sanitary service
connections to reroute wastewater into an existing sanitary sewer line. The City will
provide a video of the existing rear lot sanitary lines to confirm the presence or absence
of existing sanitary sewer taps on the lines. This will be used by BSCE during the
design.
3. Coordinate all proposed design with Jefferson County Drainage District No. 7,for areas
impacting or within their HFPL right of way.
4. Coordinate with, and provide progress prints to ALLCO,to be used for their pricing of
the emergency construction work and for value engineering and constructability to
ensure a cost effective solution has been prepared.
DeQueen Boulevard at Lakeshore Drive &Vicinity (Area 2)
5. Define the limits and provide a solution to completely fill the abandoned 36" sanitary
sewer line, which is located adjacent to the toe of the HFPL and beneath the existing
ramp on the HFPL, with a flowable fill to provide immediate protection to the levee.
This line item does not include filling the entire length of the abandoned line,but rather
only that section which extends on each side of the DeQueen pump station and is
approximately 870 feet in length.
6. Prepare a design to reroute the alignment of an existing 42"reinforced concrete storm
sewer on the south side of DeQueen to remove it from the HFPL right of way and tie it
in to an existing 6'x 6' concrete box culvert on the north side of DeQueen Blvd. The
concrete junction box that is leaking is located on this 42" line. This reroute will
eliminate the need to repair the junction box, and will allow for the removal of the 42"
line within the HFPL.
7. Prepare a design for the removal/filling of the abandoned 42" storm sewer, existing
concrete junction box, and the repair of the 6'x 6' concrete storm sewer as a result of
the 42"removal.
8. Prepare a design for the backfilling of the area located within the HFPL right of way,
utilizing levee repair methods acceptable to DD7 and the Corps of Engineers. It is the
intent of DD7 for this project to fall within the guidelines of "Operation and
Maintenance" of the levee, which will not require a specific Corps permit. However,
extremely close coordination with DD7, during design and construction, is required to
comply with this procedure.

Both Locations—General Design
9. Review available data to include drainage maps, utility maps, record drawings, video
inspection provided by Owner,and any other data that may exist and assist in the design
of this project.
10. Perform a limited topographic survey of the project area for use in design and to locate
existing utilities in areas that have not yet been surveyed (Area 1) and to supplement
existing survey data(Area 2) for use in construction.
11. Design emergency repair improvements and prepare construction plans for the
improvements identified above to include location maps, dimensional control, layout
sheets, plan and profile sheets, construction details, traffic control plan and a
stormwater pollution prevention plan(SW3P).
12. Incorporate the City's standard construction contract, or other City emergency
construction contract, and prepare a complete set of sealed Construction Documents of
Plans and Specifications.
13. Provide periodic review sets of construction plans to the City and the City's Contractor
as necessary during the design of the project.
14. Coordinate the proposed improvements with Jefferson County Drainage District No. 7,
to maintain compliance for operation and maintenance operations. Incorporate any
specific DD7 design requirements into the construction documents.
15. Furnish up to ten(10) sets of construction documents.
16. Prepare and submit a permit application or request for letter approval to DD7. We do
not expect DD7 to require any permitting or review fees. As such, there are no
permitting or review fees included with this Proposal.
17. Coordinate the need for Geotechnical Engineering services with the City. It is preferred
to use a local geotechnical engineer, retained directly by the City, to perform the in-
place density testing. There is one firm already used by DD7 for similar backfilling
operations on other HFPL projects and they are familiar with the District's standards.
The cost for these geotechnical services is not included as a part of this scope.
Construction Phase
18. Conduct a preconstruction conference with the City, Contractor and Drainage District
No. 7 and issue a Notice to Proceed on behalf of the Owner.
19. During Construction, provide necessary interpretations and clarifications of the
contract documents as may be needed or as requested by the Owner.

20. Provide construction phases services to include periodic visits to the project site at
appropriate intervals as construction proceeds to observe and report on the progress
and the quality of the executed work and to observe the progress and quality of the
executed work. This is to be distinguished from the continuous service of a resident
Project Representative that provides full time, on-site project representation.
21. Issue instructions from the owner to the constructors, issue necessary interpretations
and clarifications of contract documents, prepare change orders requiring special
inspections and testing of the work, and make recommendations as to the acceptability
of the work.
22. Prepare sketches required to resolve problems due to actual field conditions
encountered.
23. Determine amounts of progress payments due, based on degree of completion of the
work, and recommending issuance of such payments by the owner.
24. Prepare record drawings based upon actual surveyed information in the field and
information provided by the contractor. Submit one copy of the record drawings to each
the City and DD7.
COMPENSATION
Due to the sensitive nature working within the Hurricane Flood Protection Levee right of
way (and within the levee section, itself), we have made many assumptions about the amount of
design effort to meet the strict requirements by DD7 as well as the total amount of labor during
the construction phase services. We are proposing reimbursement based upon an hourly rate with
a Not To Exceed fee of$73,000.00. If we do not reach the NTE fee, the City will retain the any
unused money budgeted toward this scope. If we do run into circumstances that will cause us to
exceed this fee, we will first obtain advance authorization and approval from the City of Port
Arthur. We propose to provide these services at our current hourly rates as follows:

OFFICE MANAGER $82.00
AUTOCAD TECHNICIAN $76.00
Non-labor expense and subcontract expense (if any) at invoice cost
plus 10 percent to recover administrative cost. Automobile
mileage at $0.575 per mile. Letter and legal size copies at $0.10
per copy. Please not that we do not charge any additional fees for
GPS Survey Equipment.

If this proposal is acceptable to the City of Port Arthur, we will prepare and submit a
Contract for Professional Services utilizing the City of Port Arthur contract, or utilize a City of
Port Arthur contract for emergency services, if one exists. With your authorization we will
