AN APPROPRIATION ORDINANCE AMENDING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2014 AND ENDING SEPTEMBER 30, 2015 FOR THE EQUIPMENT REPLACEMENT FUND BY $103,000.00 IN ORDER TO FUND THE CAPITAL LEASE FOR A COMPACTOR FOR THE LANDFILL, AND TO FUND THE COST OF FREIGHT, SHIPPING AND OTHER COST/ESTIMATE DIFFERENTIALS OF VARIOUS APPROVED EQUIPMENT WHEREAS, in accordance with Article XII, Section 9, of the City Charter, the City Council may make emergency appropriations from time to time; and WHEREAS, the City Council may make budget amendments for emergencies under Section 102.009 and for Municipal purposes under Section 102.010 Local Government Code; and WHEREAS, on September 22, 2014, the City Council approved and adopted Ordinance 14-37 which appropriated the 2014-2015 budget; and WHEREAS, $103,000 additional funding is needed in the Equipment Replacement Fund for Capital Lease payments for a compactor for the landfill, $93,000 and to fund the cost of freight, shipping and other cost/estimate differentials of various approved equipment, $10,000. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the Equipment Replacement Fund budget be increased $103,000. Section 3. That Section 9 of Ordinance 14-37 be amended to read: That there be and is hereby appropriated the sum of Two Million, One Hundred Fifty Six Thousand, Nine Hundred Twenty Six Dollars ($2,156,926) to the Equipment Replacement Fund for the purchase of capital equipment. Section 4. That a copy of the caption of this Ordinance be spread upon the minutes of the City Council. Section 5. That this Ordinance shall be effective immediately.
