A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 3 TO THE AGREEMENT WITH LINEBARGER, GOGGAN, BLAIR & SAMPSON, LLP FOR THE COLLECTION OF FINES FOR MUNICIPAL COURT WHEREAS, per Resolution No. 02-44, the City Council approved a two (2) year agreement with Linebarger, Goggan, Blair, Pena & Sampson, LLP for the collection of fines for Municipal Court, with an option to grant two (2) additional two (2) year extensions, which the City granted; and WHEREAS, per Resolution No. 08-066, the City Council approved a new contract with Linebarger, Goggan, Blair & Sampson, LLP for a two (2) year agreement, with the City reserving he option to extend the initial term of the contract for two (2) additional two (2) year periods, with the contract thereafter continuing on a month-to- month basis; and WHEREAS, per Resolution No. 10-064 the City Council approved a two (2) year-extension agreement with Linebarger, Goggan, Blair & Sampson, LLP, which expired on February 27, 2012; and WHEREAS, per Resolution No. 12-267 the City Council approved a the second and final two (2) year period for the collection of fines for Municipal Court accounts; and WHEREAS, per Resolution No. 14-162 the City Council amended the Agreement as to extend the expiration date; and WHEREAS, per Resolution No. 14-605 the City Council approved a second amendment to the Agreement as to extend the expiration date; and WHEREAS, said extension expires on March 1, 2015; and WHEREAS, it is deemed necessary to extend the agreement on a month-to- month basis allowing time for the purchasing department to process a Request For Qualifications; and WHEREAS, it is in the best interests of the citizens to enter into an agreement with Linebarger, Goggan, Blair & Sampson, LLP, for the collection of fines for Municipal Court extension through May 31, 2015. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: S.pr 18845 Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager is authorized to execute Amendment No. 3 to the agreement with Linebarger, Goggan, Blair & Sampson, LLP, as to extend the agreement on a month-to-month basis as delineated and further described in the attached agreement amendment marked as Exhibit"A". Section 3. That an authorized representative of Linebarger, Goggan, Blair & Sampson, LLP will sign Amendment Three to the agreement between the City of Port Arthur and Linebarger, Goggan, Blair& Sampson, LLP. Section 4. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
