HomeMy WebLinkAboutPO 6440: AUTHORIZING THREE (3) SPECIAL WARRANTY DEEDS INTEROFFICE MEMORANDUM HOUSING ASSISTANCE PROGRAMS To: Brian McDougal, City Manager From: Beverly Freeman, Acting Director Neighborhood & Neighborhood Revitalization Date: February 24, 2015 Re: P.O. #6440 RECOMMENDATION: The Housing Division recommends City Council adopt Proposed Ordinance #6440 authorizing the City Manager to convey three (3) City owned properties to Port Arthur residents participating in the Hurricane IKE Disaster Recovery Program, who currently reside on sub-standard lots and are in need of property in compliance with City Codes. BACKGROUND: Three (3) Port Arthur Residents suffered extensive damage to their homes during Hurricane Ike in September 2008. The residents are qualified through Texas Department of Housing and Community Affairs (TDHCA) to have new homes built. The families currently reside on lots that are substandard/undersized and are in need of lots that are in compliance with the City Codes. Three (3) City owned lots have been identified and will be conveyed to the residents as follows: Address Legal 745 Booker Washington Tract 1-A Replat Lot 1 & 2 Block 26, Brice Carolyn & Gerard Addition No. 2 Nicolas 722 Booker Washington Tract 13-A Replat of Lot 13 & 14 Block 25, Michelle Getwood Brice Addition No. 1 739 Roosevelt Avenue Tract 1-A Replat of Lot 1 & 2 Block 5, Molly Hill Pekin Addition BUDGETARY/FISCAL EFFECT: N/A STAFFING/EMPLOYEE EFFECT: Housing Administration Staff will be responsible for administration. SUMMARY: The Housing Division recommends City Council adopt Proposed Ordinance #6440 authorizing the City Manager to convey three (3) City owned properties to Port Arthur residents participating in the Hurricane IKE Disaster Recovery Program, who currently reside on sub-standard lots and are in need of property in compliance with City Codes. AN ORDINANCE AUTHORIZING THREE (3) SPECIAL WARRANTY DEEDS FOR CONVEYANCE OF PROPERTY TO LOW AND MODERATE INCOME RESIDENTS OF THE CITY WHO ARE PARTICIPATING IN THE HURRICANE IKE HOUSING RECONSTRUCTION PROGRAM THROUGH THE TEXAS DEPARTMENT OF HOUSING & COMMUNITY AFFAIRS (TDHCA) WHEREAS, Section 272 . 001 (g) of the Local Government Code provides that a municipality may convey land for the development of low or moderate income housing provided that the conveyance serves a public purpose; and WHEREAS, the existing lots owned by the persons/families included herein were found unsuitable for construction as delineated in Section 10-200 of the Code of Ordinances; and WHEREAS, the City Council wishes to convey three (3) vacant lots to low and moderate income residents of the City of Port Arthur in furtherance of disaster recovery; and WHEREAS, Texas Department of Housing & Community Affairs (TDHCA) CDBG Disaster Recovery Program is providing the homes under a program utilizing federal funds awarded to the State of Texas to assist persons whose homes were damaged by Hurricane Ike and the homes shall be reconstructed at no cost to the residents; and WHEREAS, the conveyance of these lots will promote the public purposes of maintaining high quality safe housing and returning persons displaced by Hurricane Ike to permanent housing; and P 0 6440 WHEREAS, this conveyance is hereby authorized and shall be subject to the following conditions : 1 . The sale price for the lots shall be Ten and no/100 ($10 . 00) Dollars . 2 . Southeast Texas Regional Planning Commission has identified three low and moderate income residents and shall provide new construction of homes to Carolyn & Gerard Nicolas, Michelle Getwood, and Molly Hill . 3 . Should the home or homes not be constructed by September 1, 2015, the property shall revert back to the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1 . That the facts and opinions in the preamble are true and correct. SECTION 2 . That the City Council herein authorizes the City Manager to convey the real property in substantially the same form as listed in Exhibit "A" , in a Special Warranty Deed to Carolyn & Gerard Nicolas, and as listed in Exhibit "B", in a Special Warranty Deed to Michelle Getwood and, as listed in Exhibit "C" in a Special Warranty Deed to Molly Hill . SECTION 3 . If for any reason, TDHCA does not agree to construct homes under the disaster recovery program on any of the lots so transferred, and require that, while living, the transferees maintain at least three years of consecutive residency from the time of the completion of the dwellings built on these lots, the City shall have a right to void the transfer and take any improvements on the lots . That Carolyn & Gerard Nicolas agree by signing this Ordinance that if the unit at 745 Booker Washington is not constructed by September 1, 2015, they will convey the property back to the City of Port Arthur . SECTION 5 . That Michelle Getwood agrees by signing this Ordinance that if the unit at 722 Booker Washington is not constructed by September 1, 2015 she will convey the property back to the City of Port Arthur. SECTION 6. That Molly Hill agrees by signing this Ordinance that if the unit at 739 Roosevelt Avenue is not constructed by September 1, 2015, she will convey the property back to the City of Port Arthur.
