HomeMy WebLinkAboutPR 18935: SETTLEMENT OF PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $5,415.00 MADE AGAINST DEVIN MARMON AND ALLSTATE INSURANCE COMPANY CITY OF PORT ARTHUR SAFETY & RISK MANAGEMENT MEMORANDUM TO: Brian McDougal, City Manager FROM: Lisa Cotten, Safety & Risk Management Coordinator DATE: March 27, 2015 SUBJECT: A Resolution Approving a Property Damage Settlement in the Amount of$5,415.00 for Damages to the Fire Station #5 Garage Door (6099 Lewis Drive) COMMENTS RECOMMENDATION: I recommend approval of Proposed Resolution No.18935 authorizing the property damage settlement against Devin Marmon and Allstate Insurance Company (Allstate) for damage sustained to the City of Port Arthur Fire Station #5 Garage Door (6099 Lewis Drive). Allstate has offered to settle the claim for $5,415.00. This is considered a fair and reasonable settlement. BACKGROUND: On November 19, 2014, a vehicle operated by Devin Marmon struck the City of Port Arthur Fire Station #5 (6099 Lewis Drive) causing damages to the Garage Door. The investigation revealed that the driver was responsible for the accident, so a property damage claim was made against his insurer, Allstate Insurance Company. A check has been received from Allstate in the amount of $5,415.00. This amount is sufficient to repair all damages. BUDGETARY/FISCAL EFFECT: The funds received will be deposited in the Fire Department Building Maintenance Account: 001-1121- 522.32-00. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF A PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $5,415.00 MADE AGAINST DEVIN MARMON AND ALLSTATE INSURANCE COMPANY AS A RESULT OF PROPERTY DAMAGE TO THE FIRE STATION #5 GARAGE DOOR (6099 LEWIS DRIVE) WHEREAS, on November 19, 2014, a vehicle operated by Mr. Devin Marmon struck the City of Port Arthur Fire Station #5 (6099 Lewis Drive), causing damage to the Garage Door; and, WHEREAS, as a result of said collision, the City of Port Arthur filed a claim for property damage against Allstate Insurance Company for the cost of repairs; and, WHEREAS, it has been determined that $5,415.00 is a fair and reasonable settlement amount for the damage sustained. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinion in the preamble of this resolution are true and correct. Section 2. That the City Manager is hereby authorized to execute settlement in the amount of $5,415.00 from Allstate Insurance Company. Section 3. That a copy of this Resolution be spread upon the minutes of the City Council. P.R.
