HomeMy WebLinkAboutPR 18990: SETTLEMENT OF THE PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $18,161.11 MADE AGAINST JOHNIE DIXON AND PRAETORIAN INSURANCE COMPANY Citr of • cam= urt r1 jtttr INTEROFFICE MEMORANDUM Office of Safety & Risk Management Date: May 5, 2015 To: Brian McDougal, City Manager From: Lisa Colten, Safety& Risk Management Coordinator RE: A Resolution Approving a Property Damage Settlement in the Amount of$18,161.11 For Damages to City of Port Arthur Trash Truck Vehicle#1760 Nature of the request: On October 15, 2014, City of Port Arthur Equipment Operator I Anthony Jerry was driving Trash Truck Vehicle #1760 (2009 GMC C8500) in the left lane in the 1300 block of SH 73 Westbound. A vehicle driven by Johnie Dixon travelling in the right lane Westbound made an improper lane change and struck Vehicle #1760. Staff Analysis, Considerations: The investigation revealed that Mr. Dixon was responsible for the accident, so a claim was made against Praetorian Insurance Company (Praetorian), his insurer. Praetorian has offered the City of Port Arthur $18,161.11 to settle this property damage claim. This amount is sufficient to cover all property damages for Vehicle #1760. Recommendation: I recommend approval of Proposed Resolution No. 18990 authorizing the property damage settlement against Johnie Dixon and Praetorian Insurance Company, his insurer, for damage sustained to City of Port Arthur Trash Truck Vehicle #1760. The amount of the proposed settlement is $18,161.11. This is considered a fair and reasonable settlement. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF THE PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $18,161.11 MADE AGAINST JOHNIE DIXON AND PRAETORIAN INSURANCE COMPANY AS A RESULT OF PROPERTY DAMAGE TO CITY TRASH TRUCK VEHICLE #1760 WHEREAS, on October 15, 2014, City of Port Arthur Trash Truck Vehicle #1760 (2009 GMC C8500) was damaged when a vehicle, driven by Johnie Dixon, struck it in the 1300 block of SH 73 Westbound; and, WHEREAS, as a result of the collision, the City of Port Arthur has filed a claim for property damage against Mr. Dixon's insurer, Praetorian Insurance Company; and, WHEREAS, Praetorian Insurance Company has offered to settle the claim for $18,161.11, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That, the facts and opinion in the preamble of this resolution are true and correct. Section 2. That, the City Manager is hereby authorized to accept $18,161.11 from Praetorian Insurance Company in settlement of the City's property damage claim. Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council. P.R.
