R. 18976 RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 18976 that would authorize the City Manager to execute Change Order No. 3 to the contract with Excavators & Constructors, Ltd. for the construction of street paving and drainage improvements along 5th Street between DeQueen Boulevard and 6th Avenue, extending the time of said contract by eleven(11) calendar days. STAFF ANALYSIS: None. BACKGROUND: Resolution 14-294, dated July 8, 2014, awarded a contract to Excavators & Constructors, Ltd., of Port Arthur, Texas, in the amount of $1,991,843.25, for the construction of street paving and drainage improvements along 5th Street. Resolution No. 14-534, requested a time extension of four calendar days with an expected completion date of May 13, 2015, due to inclement weather. Resolution No. 14-599, requested a time extension of six calendar days with an expected completion date of May 19, 2015, also due to inclement weather. Change Order No. 3 is a request for a time extension of eleven calendar days due to weather delays during January and February. BUDGET CONSIDERATIONS: Approval of Change Order No. 3 will have no effect on the approved budget for this project. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 3 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND EXCAVATORS & CONSTRUCTORS, LTD., OF PORT ARTHUR, TEXAS, AND GLO, FOR THE CONSTRUCTION OF STREET PAVING AND DRAINAGE IMPROVEMENTS ALONG 5TH STREET, INCREASING THE TIME OF THE CONTRACT BY ELEVEN (11) CALENDAR DAYS, TO A NEW TERM OF 270 CALENDAR DAYS, AT NO ADDITIONAL COST. WHEREAS, on July 8, 2014, per Resolution No. 14-294, the City Council awarded a contract for the construction of street paving and drainage improvements to 5th Street from DeQueen Boulevard to 6th Avenue to Excavators & Constructors, LTD., of Port Arthur, Texas; and, WHEREAS, per Resolution No. 14-534, the City Council approved Change Order No. 1 increasing in the contract time by four calendar days due to weather delays; and, WHEREAS, per Resolution No. 14-599, the City Council approved Change Order No. 2 increasing the time of the contract by six calendar days due to weather delays; and WHEREAS, Excavators & Constructors, Ltd., has submitted Change Order No. 3 for the project, and the Public Works Director/City Engineer and the Project Engineer recommend approval of Change No. 3 extending the contract time by eleven calendar days due to weather delays, attached as Exhibit "A"; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 3 (attached as Exhibit "A") to the contract between the City of Port Arthur and Excavators & Constructors, Ltd., extending the contract time by eleven calendar days due to weather delays; and, PR No. 18976 05/06/15 sjp Page 2 of 2 THAT, Change Order No. 3 extends the new contract date of completion to May 30, 2015; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
