City Manager From: Susan Polka, P.E., Public Works Director/City Engineer `1 RE: Proposed Resolution No. 18983 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 18983 authorizing the renewal of an annual striping of city streets with Crabtree Barricade Systems, Inc. for the not to exceed amount of $50,000.00. BACKGROUND This was an annual contract to provide for the striping of city streets with the option to renew for two (2) more years as per Resolution No. 14-213. This is the first additional one year renewal. BUDGET/FISCAL EFFECT Funding available in Public Works/Other Contractual Services Account No. 001-1205-531.59-00. A RESOLUTION AUTHORIZING THE SECOND YEAR (FIRST RENEWAL) OF THE AGREEMENT WITH CRABTREE BARRICADE SYSTEMS, INC. OF BEAUMONT, TEXAS, FOR THE ANNUAL STRIPING OF CITY STREETS, IN AN ANNUAL NOT TO EXCEED AMOUNT OF $50,000.00 CONTINGENT ON FUNDING BEING AVAILABLE IN PUBLIC WORKS/OTHER CONTRACTUAL SERVICES ACCOUNT NO. 001-1205- 531.59-00. WHEREAS, the City of Port Arthur, Texas proposes to stripe and/or re-stripe existing and/or reconstructed roads; and, WHEREAS, the City entered into a one year agreement with Crabtree Barricade Systems per Resolution No. 14-213 for this service, with the option to renew for two (2) additional one-year periods; and, WHEREAS,this contract shall have the option for renewal of one (1) additional year; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct. THAT, the City Manager of the City of Port Arthur is hereby authorized to execute the second year (first renewal) of the contract with Crabtree Barricade Systems, Inc. of Beaumont, Texas (attached as Exhibit "A") for the Annual Striping of City Streets, in an annual not to exceed amount of$50,000, with the option to renew the contract for one (1) additional year, contingent on funding being available in Public Works/Other Contractual Services—Account No. 001-1205-531.59-00. THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Shawna Tubbs, CPPO Public Works/City Engineer Purchasing Manager Exhibit "A" RENEWAL CONTRACT FOR STRIPING OF CITY STREETS THIS AGREEMENT, made this the of May 20 15 ,_by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY", and Crabtree Barricade Systems, Inc. , hereinafter called "CONTRACTOR". WITNESSED: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution 14-213, the City entered into a one-year contract with the option of renewal for two (2) additional one-year periods. The parties hereby agree to exercise said option for a second year. 2. The term of this Contract shall be from May 13, 2015 to May 12, 2016 unless sooner terminated under the provisions hereof. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle within thirty (30) days written notice. 3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of the materials, supplies, tools, equipment, labor, and other services necessary to connection therewith, excepting those supplies specifically not required of CONTRACTOR in the Specifications. 4. The CONTRACTOR agrees to supply the materials described in the specifications and contract documents at the unit prices shown in the original bid. 5. This contract shall not exceed the amount of $50,000.00. 6. The term "Contract Documents" means and includes the following: 1) Agreement 2) Invitation to Bid* 3) Ccncral Information* 4) Specifications* 5) B-id* 6) Bidder's Information Sheet* * These items were attached to the original letting contract. The agreement only is included for this renewal. 7. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 8. IN WITNESS WHEREOF, the parties here to have executed, or caused to be executed by their duly authorized officials, this Agreement in two (2) copies, each of which shall be deemed an original of the date first written above.
