RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution No. 19011 that would authorize the
City Manager to execute Change Order No. 1 to the contract with BDS Constructors LLC, dba MK
Constructors for the construction of roadway rehabilitation and drainage improvements along 9th Street
between Williams Avenue and Duff Drive and on Duff Drive south of 9th Street, increasing the the
contract time by 69 days for a new completion date of August 8, 2015.
STAFF ANALYSIS:
None.
BACKGROUND:
Resolution 14-443, dated September 29, 2014, awarded a contract to BDS Constructors LLC, dba MK
Constructors, of Vidor, Texas, in the amount of $679,545.00, for the construction of roadway
rehabilitation and drainage improvements along 9th Street. This Change Order request is an increase in
the contract time due to allow City staff to complete reconstruction work on Duff Avenue that was not a
part of this contract to allow for the entire area to be paved at the same time. The current contract time is
180 days with a completion date of May 31, 2015. Change Order No. 1 increases the contract time by 69
days resulting in a final completion date of August 8, 2015.
BUDGET CONSIDERATIONS:
There will be no change to the project budget.

EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT
BETWEEN THE CITY OF PORT ARTHUR, GLO, AND BDS
CONSTRUCTORS, LLC, DBA MK CONSTRUCTORS OF
VIDOR, TEXAS FOR THE 9th STREET PAVING
IMPROVEMENTS PROJECT — WILLIAMS AVENUE TO
DUFF DRIVE, AND ON DUFF DRIVE SOUTH OF 9TH
STREET, INCREASING THE CONTRACT TIME BY 69
DAYS, GLO ROUND 2.1 PROGRAM, PROJECT NO. I2119,
ACCOUNT NO. 144-1201-532.59-00.
WHEREAS, on September 29, 2014, per Resolution No. 14-443, the City Council
awarded a contract for the 9th Street Improvements to BDS Constructors, LLC, dba MK
Constructors, of Vidor, Texas, in the amount of $679,545.00 with a contract time of 180 days,
said project being from Williams Avenue to Duff Drive and Duff Drive south of 9th Street; and,
WHEREAS, the City requested the Contractor to stop work in order for City staff to
complete roadway base and concrete curb and gutter work on a segment of Duff Drive not
included in the contract, in order to complete roadway reconstruction in the area; and
WHEREAS, BDS Constructors, LLC, dba MK Constructors, has submitted Change
Order No. 1 for contract time extension and the Public Works Director/City Engineer and the
Project Engineer recommend approval of Change Order No. 1 in the increased time of 69 days
attached as Exhibit"A"; NOW THEREFORE,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to
execute, on behalf of the City of Port Arthur, Change Order No. 1 (attached as Exhibit "A") to
the contract between the City of Port Arthur and BDS Constructors, LLC, dba MK Constructors,
increasing the total contract time by 69 days; and,
THAT, Change Order No. 1 increases the contract time to a new total of 249 days for a
completion date of August 8, 2015; and,
THAT, a copy of the caption of this resolution be spread upon the minutes of the City
Council.

Dear Ms. Polka:
Attached is Change Order No. 1 for the Roadway Rehabilitation & Drainage Improvements
along 9th Street. This change order is for a time extension of 69 days to allow for the completion
for the city employees to complete their work on Duff Avenue. The contractor was instructed to
stop work to allow the City of Port Arthur employees to complete their construction work on Duff
Avenue before finishing the street to avoid having to reconstruct that section of roadway again.
I recommend that the City of Port Arthur authorize this change to the contract. I have attached
Change Order No. 1 which modifies the contract to reflect this change for your consideration
and action. Should you have any questions or require additional information, please contact our
office.
