For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: Agua Vista is a fully furnished home complete with standard household items such as basic cooking pots, pans, place settings, equipped with your basic kitchen appliances including a full washer/dryer & basic household furnishings such as beds, couches, dining room table, TVs, lamps, etc. Your rental rates also include bed, bath, kitchen and pool linens. LH will be responsible for the inventory of the household. Please do not remove any household possessions. A full inventory of household items is conducted after each exiting reservation. LH will maintain the condo in a nice, clean and "ready to rent" condition at all times and may use the condo only in a respectful and lawful manner. The LH will leave the condo in a "ready to rent" condition at the time this agreement expires, defined by Best of the West. LH will pay for all incomplete check- out procedures, damages and repairs should the unit be left in a "lesser" condition. LH agrees Best of the West will deduct cost of services from security deposits in order to replace or repair home to original condition and/or its furnishings. LH is responsible for all damages done to the premises & its contents over and above the "normal wear and tear". LH is renting the use of the home and its contents only, all resort amenities/common areas/services are an added plus to renting a home in Pointe West Resort. Resort amenities/common areas/services are not managed or maintained by Best of the West. LH agrees to indemnify and hold harmless Best of the West from any liabilities, damages, costs or expenses whatsoever arising from or related to any claim or litigation which may arise out of or in connection with LH's use and occupancy of the Rental Property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by LH. In the event that it is necessary to retain an attorney to enforce the terms of this Lease, the prevailing party shall be entitled to reasonable attorney's fees and court costs required to do so. All legal proceedings must take place in Galveston County, Texas. LH agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by the Best of the West enforcing this agreement. Occupancy Terms: The maximum number of overnight guests is limited to 7 persons. The maximum occupancy for day visitors is 4 additional persons. Occupancy of the home shall never exceed 11 or more without proper permission from Best of the West. ALL guests using the home & resort amenities must be listed on form titled Guest www.bestofthewestgal veston.com Page 3 of 10 & Vehicle Registration & submitted for approval. Violation of this could result in eviction and loss of payment. LH expressly acknowledges and approves this agreement is for transient occupancy of the property, and that LH does not intend to make the property a residence or household. LH cannot sublet the property and must accompany all guests to the Beach Club Amenities. Homeowner/Best of the West assumes no responsibility for illness or injury that may incur to humans while on the premises. Pet Policy: Best of the West does offer pet friendly homes; there is an additional required, non-refundable $100 pet fee (plus tax) for each pet in addition to the signed Pet Addendum paperwork, approved. LH accepts responsibility for any pet damages & will be deducted from Security Deposit. Some homes will accept pets on a case by case request, same policies apply. LH agrees to comply with the Pet Addendum while on property. Homeowner/Best of the West assumes no responsibility for illness or injury that may incur to pets or humans while on the premises. No pets or animals of any kind are authorized to be on property unless they have been approved in advance, proper paperwork has been submitted & pet fees have been paid. Any violation of the Pet Agreement could result in eviction and loss of funds. This Pet Policy applies to all "day guests" who bring a pet, as well as "overnight guests". Rental Rules: LH agrees to abide by the terms listed in this agreement, including all attached articles, at all times while occupying the home and Pointe West Resort; and shall cause all members of the rental party listed as guests permitted on the property to abide by the following rules at all times while at the property. LH will behave in a civilized manner and be good neighbors, respecting the rights of others and the guidelines listed from the P.O.A. Creating a disturbance anywhere on property of the resort will be grounds for immediate termination of this agreement and LH will immediately vacate from home and resort property. All monies will be forfeited. Pointe West Resort as a whole, does not encourage renting to prom parties or under age, unsupervised gatherings. Best of the West will not enter into agreement with anyone under the age of 26 & will not agree to host these types of gatherings. Any efforts to deceive Best of the West of other than obvious rental intent will result in immediate eviction of the home & the resort, forfeiting all monies paid. Best of the West does not allow any use of illegal drugs or underage drinking during the period of the Agreement. Property Access: LH shall allow Homeowner & Best of the West access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. Best of the West will have right to inspect the property without prior notification, at any time to enforce the terms of this agreement. Should the LH violate any of the terms of this agreement, Best of the West may terminate this agreement immediately. LH waves all rights to process if they fail to vacate the premises upon termination of this agreement. LH will vacate the home at the agreed time and dates listed on this agreement. It is for the protection of the home & contents. LH must leave the home in good "ready to rent" condition by the time specified. LH is responsible for all damages done to the premises over and above the "normal wear and tear". LH shall pay for any damage to the home & its contents caused during his/her possession. If the LH fails to comply with this Section, Owner/Best of the West may complete the work, clean or make repairs & bill the LH for charges accrued. Nothing in this lease shall prevent Owner/Best of the West's right to recover any sum due from the security deposit and pursue LH for any billed invoices not covered by the Security Deposit. Refund Policy: As our guest, you are renting the use of a fully furnished home & the contents within the home, not the use of Beach Club amenities. Best of the West will have properly prepared for your arrival as close as possible to the images you have seen online & all basic essentials will be met & provided. There are some amenities that Best of the West has no control over. If reported to Best of the West, we will make steps to notify the proper entity in management of the issue & communicate with the LH on the status of the situation. If for some reason Agua Vista is not available for reasons beyond the control of Best of the West, Best of the West will place LH in a home of equal or more value or issue a refund. Best of the West cannot be held liable for problems we have not been alerted to. If any questions about the condition of a particular issue, or one that may arise during your stay, you must notify Best of the West immediately at the current time. A verbal or written list of unsatisfactory issues presented at time of check-out or after departure will not be considered. Any refunds issued will be returned in the same form as it was received unless otherwise agreed by the LH & Best of the West. Cell Phone/Cable/ Internet Services/Electronic Equipment: Being located on Galveston Island's most western tip, we occasionally experience service outages that are beyond our control. Cell phone, cable & internet services are unpredictable so these are not a guarantee during your stay. We will do our best to resolve issues with internet, cable & electronic equipment. Unfortunately, in some instances the acts of correction may be beyond Best of the West's control. No refunds or compensation will be issued for any outages or malfunctions. You may experience cell service issues depending on your location, service carrier or the direction of Mother Nature. Acts of God/ Utilities: There will be no refunds issued, for any reason, should you choose to make your departure earlier than the dates listed on this agreement. It is with this in mind, we strongly recommend travel insurance, especially during hurricane season. There shall be no refunds of rents because of shortened stays or ruined expectations because of weather conditions. Depending on the occupancy of the West End of the Island, we do occasionally experience low levels of water pressure from time to time. Being located in the middle of nature, we also experience high winds and other acts of God that are beyond our control such as power outages & storms. We will do our best to resolve reported issues. Unfortunately, in some instances the acts of correction may be beyond Best of the www.bestofthewestgalveston.com Page 5 of 10 West's control. No refunds or compensation will be issued for any outages or malfunctions unless the issue is not resolved within a 24 hour period after being reported. If services are not able to be restored during your stay, Best of the West will first attempt to move LH to another unit, if possible. If another unit is not available, Best of the West will refund your remaining stay. Point West Resort Beach Club Amenities & Common Services: LH is renting the use of the home and its contents only, all resort amenities are an added plus to renting a unit in Pointe West Resort. Any issues that may arise during your stay pertaining to the Beach Club or common area amenities that are offered on property are beyond control of Best of the West. Examples include, but are not limited to closure of Beach Club pool sites & all features located under their management, common area fire systems, all property elevators, and other property common areas. Examples include, but are not limited to, fire alarm systems, elevators, mosquito control, construction/repairs being conducted in the area etc. Cleaning & Linens Fee: As part of your rental, all beds assigned will be dressed (excluding blow up mattresses) and includes kitchen linens, bath linens and pool towels, one set per person. Please be aware that the LH is responsible for these items, so please make sure all pool towels have been returned & all other linens are left in good condition before you depart. If something happens to linens during your stay, please notify Best of the West immediately. Agua Vista is furnished with a full washer/dryer and Best of the West provides laundry detergent & fabric sheets for your use. Please feel free to wash what you need while you stay. The cleaning fee paid for your stay is an "exit clean". The home should be clean upon your arrival. If there is an issue with the cleanliness, please give us a call within 2 hours of your personalized check-in greeting. A verbal or written list of unsatisfactory issues presented at time of check-out or after departure will not be considered. If you would like to have our cleaning services during your stay, please ask for more details. Please make sure to review, complete & return the Linen Policy Form, Attachment #2, along with your Rental Agreement paperwork. If this portion is not completed & returned we may not have all bedding/linens prepared properly for your stay. Lock System/Lock Outs: Agua Vista is equipped with a mechanical lock system. You will receive your own personalized door code upon your arrival. As part of your personalized check-in, we will take you through a demonstration on how to use the locking system. Your door code will expire at the designated check out time listed on this agreement. If you need extended time, you must contact Best of the West to make arrangements. During the peak times (March, May-August), due the high volume we unfortunately cannot arrange late check-out times. Should you be persuaded to extend your stay with us, a new code will be issued for the extended time period. This code is only for access to your home, not to the Beach Club Amenities. A separate code will be issued by the Beach Club, listed on your wristband, they will give you upon registration. From time to time we do experience technical difficulties, please give Best of the West a call for assistance. Please do not attempt to resolve a problem with the www.bestofthewestgalveston.com Page 6 of 10 mechanical locking system without communicating with Best of the West. If damage occurs, LH will be responsible for repair. Be advised some interior doors are equipped with doorknob locks for personal privacy. We advise LH to supervise children & do not leave them unattended in rooms with privacy doorknob locks. In the event someone is locked in a room & a locksmith is required due to lockout, the LH will be responsible for payment of the locksmith's invoice at time of service, as well as any damages that may occur to the door or door frame. Safety Awareness Policy: For more information, please refer to Attachment #6. We have provided some guidelines for safety awareness of Pointe West Resort, Agua Vista& City of Galveston. Please make sure you inform all guests you host of these guidelines. Homeowner/Best of the West assumes no responsibility for illness or injury that may incur to pets or humans while on the premises. I understand that Agua Vista& Best of the West provide basic household consumables & beach/pool/recreational equipment to enhance our rental experience. All guests acknowledge these items are optional for use & are to be used at their own risk. Please report any items you feel may be unsafe to Best of the West as soon as possible. We ask that if there are questions on the consumable items, please refer to the listed ingredients & suggested use of these items. Homeowner/Best of the West assumes no responsibility for illness or injury that may incur while on the using these items. Best of the West offers an activity program for our guests. We provide the basic supplies needed for each activity. All guests acknowledge these activities are optional & participate at their own risk. Each adult is responsible for their actions & safety as well as children under their supervision. Please note our crabbing activity uses raw chicken for bait & involves being close to the water. If we manage to catch crab, we give you time to observe, learn & study the beauty of these creatures, handle all wildlife at your own risk. For our Fire Pit Social, we will roast s'mores over an open fire pit. We use graham crackers, plain marshmallows & Nutella for our ingredients. Homeowner/Best of the West assumes no responsibility for illness or injury that may incur while participating in these events or other activities offered. Media Clause: During our activities & other times, Best of the West will take pictures/videos. These images may be posted on our Facebook pages, website &/or other media venues. If LH or guests have objections to having their image(s) posted, it is the responsibility of the LH to notify Best of the West before check-in via email. We invite you to share your experiences with us as well. Please feel free to upload your pictures/videos on our Facebook pages & tag yourself. Non-Disparagement Clause: In an effort to ensure fair & honest public feedback & to prevent the publishing of libelous content in any form, your acceptance of this agreement prohibits LH & registered guests from taking any action that negatively impacts Best of the West. Should this clause be violated, as determined by Best of the West in its sole discretion, you will be provided a (72) hours opportunity to retract the content in question. If content remains, in whole or part, you will be immediately billed for damages, legal fees & court costs until such complete costs are determined in www.bestofthewestgalveston.com Page 7 of 10 litigation. Should these charges remained unpaid for over 30 calendar days from the billing date, your unpaid invoice will be forwarded to a third party collection firm & will be reported to consumer credit reporting agencies until paid. Lost and Found: In reflecting on this past summer operations, we quickly realized, no matter how much we try to remind our guests to make sure to pack everything for the trip home, it seems MOST guests want to leave a reason to get back in touch with us. We had an overwhelming amount of items left behind; so it is with this & a few other features that sparked the idea of our new Security Deposit Policy. Any items left in the home after your departure will be returned to the address listed on this agreement & expenses will be deducted from the security deposit. In signing this agreement, LH acknowledges that the return of all Lost & Found items will be deducted from LH's form of security deposit. Check-Out Procedures: You will receive a checklist of procedures that we require LH & guests to complete before vacating Agua Vista. The home & its contents must be left in a "ready to rent" condition. Housekeeping services will be responsible for a basic cleaning, linen services, sterilization, etc. Our check-out checklist is on the lighter side, compared to most, but we do ask for your help with some things to help ensure the home is prepared properly for our next guest as it was for you when you arrived. If you are unable to complete the Checkout Checklist, please contact Best of the West. If excessive cleaning is required from leaving the home excessively dirty or checklist tasks are not completed, all charges will be deducted from LH's form of security deposit. In signing this agreement, LH acknowledges all charges explained in this section. Check-In/Check-Out Times: Check-in time is any time after 4pm, check-out is no later than l lam. During the months of May, June, July & August, we will not be able to adjust these times. Please remember we only have a 5 hour turnaround time during our peak season. Most homes have guests leaving on the day of your arrival & guest arriving on the day of your departure. In order to have the home properly prepared for everyone our Housekeeping & Inspections staffs need every minute to prepare/restock/repair items within the home. Please DO NOT pressure our staff to adjust these time. As part of our Arrival Packet, sent to you at a later time, we will include information about our personalized check-in procedures. During our off season months (October-April) Best of the West offers an early check-in (12pm)/late check-out program (6pm). Do not back your vehicle into garage parking space -trailer hitches and/or bumpers extend over the tire stops and will damage the garage wall. Your vehicle will be stickered by property security if it is improperly parked or occupying another's space. If additional parking is needed, vehicles may park in the unassigned spaces outlined in white stripes located around the buildings. Only pool/beach towels are allowed to be removed from Bright Side, but must remain on Pointe West Property. Linens provided are intended for use of overnight guests. Any daytime guests will have to provide their own. Please be aware linens provided are NOT treated to resist Benzoyl Peroxide, Acetone, Hydrogen Peroxide, Hydroquinone, Bleach or other like chemicals that are contained in hair dyes, acne products, make-up remover and other health & beauty needs. Please check the ingredients on your labels before using our custom linens. In order to provide top service, Best of the West provides make-up removal wipes as part of your stay. Any linens left with bleach stains after your departure will have to be replaced at the cost of the Lease Holder. Please inquire for more information. Bed Linens I understand that Best of the West will provide 1 set of bed linens for each sleeping accommodation. Each sleeping accommodation has been prepared for your arrival. Each twin bed will have a waterproof mattress pad, fitted sheet, flat sheet, blanket, pillow, decorative comforter and decorative pillows. Each convertible couch,full, queen or king will have a waterproof mattress pad,fitted sheet,flat sheet, blanket, at least 2 pillows, decorative comforter and decorative pillows. All decorative comforters will be turned down & decorative pillows will be removed before use. Please understand that these are not considered functional linens& use to enhance the atmosphere for your stay. If decorative bedding is stained, a professional cleaning service may be required. If decorative bedding is found to be left in an unacceptable or unrepairable condition, replacement of entire set may be required. Please leave all used beds unmade before departure. Bath Linens I understand that Best of the West provides a set of bath linens per person which includes 1 bath towel, 1 hand towel & 1 wash cloth. Should you need more towels, please give us a call to make arrangements for service, or you may use the full sized washer&dryer. Best of the West provides laundry detergent&fabric softener sheets. Each bathroom also comes with at least 1 bath mat per bathroom. Kitchen Linens I understand that Best of the West provides a set of kitchen linens, depending on the length of your stay. 2-5 night stay is 3 dish towels, 5 night stay or more 6 dish towels. Also included are pot holders &owner's choice of linen napkins and/or placemats. Pool Towels I understand that Best of the West provides 1 pool towel per person. Guests are more than welcome to use at the beach. If you do take pool towels to the beach, we ask that you please shake out as much sand as possible & leave in cage or balcony for storing. Please help us keep our sand at the beach & not in the condo. Please make sure to bring all towels back to the unit before departure & leave in corner of main balcony. - Agua Vista sleeps 7 people. We are the only rental company who prepares all beds for your arrival. In order to properly prepare for your stay & help you with your planning, please let us know what beds need to be made.
