RECOMMENDATION
I recommend that the City Council approve P.R. No. 19017 authorizing a second contract extension with
Ergonomic Transportation Solutions, Inc. (ETSI) from June 9, 2015 to June 8, 2016, to perform the
engineering design for a traffic signal at the intersection of 9th Avenue and Lake Arthur Drive for no
additional cost.
BACKGROUND
Per Resolution 13-531, the City of Port Arthur entered into a contract with Ergonomic Transportation
Solutions, Inc. (ETSI) which ended March 9, 2014. Per Resolution 14-126, a contract extension was
accepted to continue the performance of engineering services. A second extension is needed to continue a
contract with Ergonomic Transportation Solutions, Inc. (ETSI) to perform the engineering design for a
traffic signal at the intersection of 9th Avenue and Lake Arthur Drive for no additional cost.
BUDGET/FISCAL EFFECT
Funds are available in account Professional Services 001-1202-531.54-00.
STAFFING/EMPLOYEE EFFECT
None
SUMMARY
I recommend that the City Council approve P.R. No. 19017 authorizing a second contract extension with
Ergonomic Transportation Solutions, Inc. (ETSI) from June 9, 2015 to June 8, 2016, to perform the
engineering design for a traffic signal at the intersection of 9th Avenue and Lake Arthur Drive for no
additional cost.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
A CONTRACT EXTENSION FOR PROFESSIONAL SERVICES
BETWEEN THE CITY OF PORT ARTHUR AND ERGONOMICS
TRANSPORTATION SOLUTIONS, INC. OF HOUSTON, TEXAS TO
PROVIDE THE ENGINEERING DESIGN FOR A TRAFFIC SIGNAL AT
9TH AVENUE AND LAKE ARTHUR DRIVE FOR NO ADDITIONAL
COST.
WHEREAS, per Resolution 13-531 the City of Port Arthur entered into a contract
with Ergonomic Transportation Solutions, Inc. to provide engineering design services for
a traffic signal at 9th Avenue and Lake Arthur Drive due to Police Department's request
from December, 9, 2013 to March 9, 2014; and,
WHEREAS, per Resolution 14-126 the City of Port Arthur authorized a contract
extension for professional services for a traffic signal at 9th Avenue and Lake Arthur
Drive from March 10, 2014 to June 8, 2015; and,
WHEREAS, a second contract extension from June 9, 2015 to June 8, 2016 is
needed to continue the engineering design services for this project; and,
WHEREAS, funding is available in account number 001-1202-531.54-00;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is hereby authorized to execute a contract extension
with Ergonomic Transportation Solutions, Inc. for engineering services for a traffic

signal at 9th Avenue and Lake Arthur Drive for no additional cost, funding being
available in account 001-1202-531.54-00, in substantially the same form as Exhibit "A";
and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

EXHIBIT "A"
SECOND CONTRACT EXTENSION FOR
TRAFFIC SIGNAL DESIGN: 9TH AVENUE AT LAKE
ARTHUR DRIVE IN PORT ARTHUR, TEXAS
THIS AGREEMENT, made this day of June , 2015, by and between
the City of Port Arthur, a municipal corporation organized under the laws of the State of
Texas, hereinafter called "OWNER" or "CITY", and
Ergonomic Transportation Solutions, Inc. a(n) Corporation herein
acting by and Individual,firm, partnership, or corporation
through Harry C. Simeonidis, P.E., Principal hereinafter called "CONTRACTOR".
WITNESSETH: That for and in consideration of the payment terms, conditions, and
agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Contract extension shall be for a period of 365 days from the
date of execution.
2. During the term of this Contract, the CONTRACTOR will furnish at his own expense
all of the materials, supplies, tools, equipment, labor, and other services necessary
to connection therewith, excepting those supplies specifically not required of
CONTRACTOR in the Specifications.
3. The CONTRACTOR agrees to perform all the work described in the Specifications
and Contract Documents and comply with the terms therein for the prices as stated
in the original proposal for the amount of $39,638.72.
4. The term "Contract Documents" means and includes the following:
(A) Agreement (Extension)
(B) Advcrtiscmcnt for Bids
(C) Gcncrol Information
(D) Specifications *
(E) Proposal *
(F) Bidder's Information Sheet *
(G) Notice to Proceed *
*These items were attached to the original letting contract. This agreement
is only included in this extension.

5. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors, and assigns.
6. The CONTRACTOR will provide performance and payment bonds as required.
7. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be
executed by their duly authorized officials, this Agreement in two (2) copies, each of
which shall be deemed an original on the date first written above.
