L RE: Proposed Resolution No. 19023 RECOMMENDATION I recommend that the City Council approve P. R. No. 19023 authorizing the City Manager to execute Change Order No. 4 to the contract between the City of Port Arthur and Excavators & Constructors, LTD., of Port Arthur, Texas and the GLO for the construction of street paving and drainage improvements along 5th Street increasing the contract time by seventeen (17) days, to a new term of 308 calendar days at no additional cost. BACKGROUND Per Resolution 14-294, a construction contract was awarded to Excavators & Constructors, LTD. for the 5th Street Drainage Improvements and Street Paving from DeQueen Blvd. to 6th Avenue for a term of 270 calendar days. Per Resolution 14-534, the City Council approved Change Order No. 1 to the contract increasing the term by four (4) days to 274 calendar days. Per Resolution 14-599, the City Council approved Change Order No. 2 to the contract increasing the term by six (6) days to 280 calendar days. Per Resolution 15-184, the City Council approved Change Order No. 3 to the contract increasing the term by eleven (11) days to 291 calendar days. Excavators & Constructors, LTD., request additional time extension of seventeen (17) calendar days due to rain delays during the construction period increasing the term to 308 calendar days. BUDGET/FISCAL EFFECT Funds are available in account CDBG Streets Program 001-1203-531.86-01 STAFFING/EMPLOYEE EFFECT None SUMMARY I recommend that the City Council approve P. R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 4 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND EXCAVATORS & CONSTRUCTORS, LTD., OF PORT ARTHUR, TEXAS, AND GLO, FOR THE CONSTRUCTION OF STREET PAVING AND DRAINAGE IMPROVEMENTS ALONG STH STREET, INCREASING THE TIME OF THE CONTRACT BY SEVENTEEN (17) CALENDAR DAYS, TO A NEW TERM OF 308 CALENDAR DAYS, AT NO ADDITIONAL COST. WHEREAS, per Resolution No. 14-294, the City Council awarded a contract for the construction of street paving and drainage improvements to 5th Street from DeQueen Blvd. to 6th Avenue to Excavators & Constructors, LTD., of Port Arthur, Texas; and, WHEREAS, the construction of storm sewer improvements began on August 13, 2014, with a contract time of 270 calendar days and ending date of May 9, 2015; and WHEREAS, the purchase order issued for this project has a completion date of May 9, 2015; and WHEREAS, per Resolution No. 14-534, the City Council approved Change Order No. 1 to the contract increasing the contract time by four (4) days to 274 calendar days; and, WHEREAS, per Resolution No. 14-599, the City Council approved Change Order No. 2 to the contract increasing the contract time by six (6) days to 280 calendar days; and, P.R. No. 19023 06/04/2015 rtb Page 2 WHEREAS, per Resolution No. 15-184, the City Council approved Change Order No. 3 to the contract increasing the contract time by eleven (11) days to 291 calendar days; and, WHEREAS, Excavators & Constructors, LTD., had requested a time extension of seventeen (17) calendars days to their contract for rain delays during the construction period; and, WHEREAS, our project engineer, Arceneaux, Wilson, & Cole LLC, has examined the request and recommends proposed Change Order No. 4 in the amount of seventeen (17) calendar days to be added to the contract time for Excavators & Constructors, LTD., said Change order No. 4 being attached as Exhibit ''A"; and, WHEREAS, the new ending date for Excavators & Constructors, LTD.'s contract would be June 16, 2015, if the Change Order is approved; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 4, attached as Exhibit "A" to the contract between the City of Port Arthur, Texas and Excavators & Constructors, LTD., for the extension of said contract by seventeen (17) calendar days, with the new ending date of the contract being June 16, 2015; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
