AN ORDINANCE AMENDING CHAPTER 70 PARKS AND RECREATION SECTION 70-45 HORSEBACK RIDING AND SECTION 70-60 TRAFFIC PROVIDING FOR A BAN OF ATVS AND HORSES ON PUBLIC PARKS; PROVIDING FOR PENALTIES AND EFFECTIVE DATE AND FOR PUBLICATION THEREOF WHEREAS, the City of Port Arthur desires to properly control use of public parks for the benefit of all citizens; and, WHEREAS, the City Council of the City of Port Arthur deems it necessary and proper to amend Chapter 70 (Parks and Recreation) of the Code of Ordinances to effect such control . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Section 70-45 Horseback Riding of the City of Port Arthur Code of Ordinances shall be amended as follows : "No person shall ride, graze, walk or otherwise present a horse on a public park. The City Manager and the Director of Parks and Recreation may grant a waiver of this provision for properly City sanctioned events due to the potential health and safety concerns related to refuse and physical danger that may be imposed. " Section 3 . That Subsection 5 of Section 70-60 Traffic of the City of Port Arthur Code of Ordinances shall be amended as follows : "...parking areas by the director. No person may operate, drive, or otherwise use any motorized vehicle which is not licensed for use on a public thoroughfare, designated for off-road use or categorized as an ATV, dirt-bike, or similar vehicle. That any person, firm or corporation who violates Subsection 70-45 of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not exceeding two thousand ($2, 000 . 00) dollars as provided in Chapter 1, Section 1-13 of the Code of Ordinances, and each day the violation continues shall constitute a separate offense. Section 5. That any person, firm or corporation who violates Subsection 70-60 of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not exceeding five hundred ($500 . 00) dollars as provided in Chapter 1, Section 1-13 of the Code of Ordinances, and each day the violation continues shall constitute a separate offense . Section 6 . That this Ordinance shall be effective immediately after the date of publication. Section 7 . That pursuant to Section 52 . 013 of the Texas Local Government Code, this Ordinance which carries a penalty is required to be published of least twice in the official newspaper of the City of Port Arthur. Section 8 . That all ordinances, resolution, or parts thereof, that are in conflict or inconsistent with any provision of this Ordinance are hereby repealed to the extent of suck conflict, and the provision of this Ordinance shall be and remain controlling as to the matters regulated, herein. Section 9 . That should any of the clauses, sentences, paragraphs, sections or parts of this Ordinance be deemed invalid, unconstitutional, or unenforceable by a court of law or administrative P. O. No. 6474 07/01/15 att agency with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this Ordinance. Section 10. That the City Secretary is hereby directed to record and publish the attached rules, regulations, and policies in the City' s Code of Ordinances as authorized by Section 52 . 001 of the Texas Local Government Code. Section 11. That a copy of this Ordinance be spread upon the Minutes of the City Council .
