No. 19066 for Council to consider authorizing a license for the location of a Recreational Vehicle Park on 12.665 Acres on Lots 6 and 7, Camellia Plaza, located behind the Three Rivers Inn at the eastern corner of Texas 73 and West Port Arthur Road. Staff Analysis/Considerations: The Recreational Vehicle Ordinance requires a license issued by the City Council to allow the construction of an RV Park in appropriately-zoned districts in the City. During the fall of 2006, City Councilmembers expressed concern that the existing city code did not include provisions for Council consideration and approval of developer plans to locate and construct RV Parks. Following Hurricane Rita in 2005 and the announcement of several planned industry expansions, a number of new RV parks were built to provide temporary housing for storm victims and for out-of-town workers employed for the industrial construction projects. This concern resulted in the unanimous adoption of Ordinance 06- 110 on Dec. 4, 2006, which increased the minimum RV Park size from two (2) acres to five (5) acres and created a Council-granted license for the location and construction of RV Parks in appropriately-zoned districts of the City. At the time of passage, several councilmembers praised the new requirement as a mechanism to allow the Council to consider the appropriateness of an RV Park's location and development and how well it complies with the City's Comprehensive Plan. Others commented that "too many" RV Parks could negatively affect the city's apartment complexes and hotels, which would lose occupants to the parks. We have experienced some issues at the RV Park located on 95th Street, a facility at least partially owned by Scott Monroe, the applicant for this park license currently under consideration. At this park, management has permanently installed some "Park Model RVs" and then rented them out on a weekly or monthly basis, much as one would rent out hotel or motel rooms on a weekly or monthly basis. The City's RV Ordinance does not provide for this practice. The legal department is currently negotiating with the RV Park owner with the idea that the management will begin to collect and pay to the city hotel/motel occupancy tax when customers rent the RVs in this manner. The city can benefit by collecting these occupancy tax proceeds. Instead, the officers can concentrate on making sure the park management keeps the required annual licenses are up to date. Recommendation: RV parks have a negative effect on hotel/motel occupancy rates and on hotel/motel occupancy tax proceeds. In addition, these parks negatively affect the occupancy rates in the city's apartment complexes. Therefore, staff recommends that this request be denied. The person intending to establish a recreational vehicle park must abide by the following: (1) Application for license. Application for the initial license to operate a recreational vehicle park shall be made to the city council of the City of Port Arthur. Such application shall state the name and address of the person desiring to engage in such business, and if the applicant is a partnership or corporation, the names and addresses of the respective partners and/or directors, and a description of the property, including street address of the premises where such RV park is to be operated so that it can be easily identified. It shall also give the name of the owner of such premises, and such other and further information as may be required by the city. (2) Required; duration. It shall be unlawful for any person to establish, maintain, conduct or operate any present or future recreational vehicle park within the limits of the city without first obtaining a license therefor from the city. Such license shall be for the calendar year or any part of such year, ending on December 31 of each year. Application for the renewal of a license shall be made to the superintendent of inspectors. (3) Fee. The annual fee for each license or renewal to operate a business park shall be $1.00 per site for the first 50 sites, plus$0.50 for each RV site over and above 50 RV sites in an RV park. (4) Display. The license for recreational vehicle parks must be conspicuously displayed at such parks at all times. (Code 1961, § 13A-39; Ord. Results showed Matt Wald consumers in general don't recognize the phrases "recreational park trailer"or"destination camping" but have a far better understanding of phrases such as "park models" and "seasonal camping," Matt Wald, the RVIA's recreational park trailer executive director, told WCM. To help clear up the confusion, the RVIA's ad hoc Destination Camping Committee that commissioned the study has recommended to the RVIA board that it adopt the phrases park model and seasonal camping and drop the other terms. The board will take up the recommendations at its March meeting, Wald said. In the meantime, the Destination Camping Committee and the Recreational Park Trailer committees, whose names may be changed pending the RVIA board action, won't be meeting again until Committee Week in June, Wald said. Trough Not As Deep As Commonly Thought The decline that the park model industry has sustained since reaching an all-time high of 10,143 wholesale shipments in 2006 is not as deep as it is often portrayed, Wald pointed out to WCM. Shipments have tailed off each year since then and have not topped 4,000 in either of the last two years. However, what was counted as a park model in previous years creates a proverbial "apples and oranges" dilemma. Up until 2007, not only was the economy stronger than it is today, but also until then all trailer-type units that measured between 320 and 400 square feet were counted as a park model. Starting in 2008, RVIA allowed travel trailers to be built up to 400 square feet rather than limiting them to 320 square feet. Since then, many units that would have been counted as 8 1/2-foot-wide park models are now rightfully counted as travel trailers. "Overall, it looks like a desperate fall," Wald said. "But if you look just at the over-81/2-foot- wide-park models, it still is down but not nearly as much as the overall number would seem to indicate. In fact, it is right in line with other RV types." And Wald and the RVIA report some success in tackling the task of accurate record keeping to track wholesale shipments of park models. Until July 2012, shipments were tracked by the RPTIA. Figures for the first half of 2012 were spotty and incomplete and, according to Wald, understate actual production figures. For that reason, monthly RVIA wholesale shipment reports do not provide a year-over-year tabulation for park models for the entire year. But Wald has coaxed park model manufacturers to go back in their 2012 records to try to recreate a better accounting of their production for the first half of the year. Once better accounting is complete, Wald hopes RVIA will be able soon to report a more complete picture for comparison purposes. file:///D:/CITY%20BUSINESS/RV%20Parks/RV%20vs%20Park%20Mode1%20Units/RV... 7/16/2015 Exhibit "D" RVIA Park Model RVs (aka Recreational Park Trailers): Definition and Use What a Park Model RV is: A park model RV(PMRV) is a unique trailer-type RV that is designed to provide temporary accommodation for recreation,camping or seasonal use. PMRVs(also sometimes referred to as recreational park trailers)are built on a single chassis,mounted on wheels and have a gross trailer area not exceeding 400 square feet in the set-up mode. They are certified by their manufacturers as complying with the ANSI A119.5 standard for recreational park trailers. PMRVs are most often used in recreational vehicle campgrounds.They may be owned by the campground and rented to guests or they may be brought in and used exclusively by their owners on a site rented or leased from the campground. They can also be placed by their owners on private property. These units are designed and built to be used for recreational/camping purposes only. They are not meant to be affixed to the property in any way,they do not improve property values in any way,and they are neither designed nor intended by their manufacturers to be used as permanent residences. Park model RVs are titled as motor vehicles by the various states just like other RV types. What makes PMRVs unique is that they are up to 15 feet in width or 36 feet long with a peaked and shingled or metal roof. Some offer gabled windows,and siding choices of cedar,aluminum,vinyl, masonite or even split logs for a rustic look,while others are made of full solid logs. They are often designed with built-in porches,decks and/or storage areas. Many look like tiny summer cottages.Others look more like traditional but slightly longer RV travel trailers. Most park model RV owners(67%)locate their unit within several hours of drive time from their primary residences and use them for weekend camping get-aways. Some owners may place their PMRV in a warm climate location and use them as a seasonal/temporary get-away to escape the cold gray winter weather,while others place their PMRVs in cooler climate locations to escape the summer heat and humidity back home. In the off-season,these units are typically winterized(i.e.have antifreeze in the water lines;and are unusable because water and sewage facilities are not operational).These units are left in"onsite storage"when not being used. The Recreation Vehicle Industry Association(RVIA)operates a safety standards and inspection program that requires member manufacturers of all recreation vehicles,including park model RVs,to affix a RVIA standards program seal to . every unit they build in their factories.This seal indicates the manufacturer's certification that the unit complies with the requirements of the applicable standards. A park model RV can always be identified by the blue and gold RVIA ANSI A 119.5 certification seal(or its predecessor green RPTIA seal)affixed to the right of main door of the unit. PMRVs are actually titled and registered just like any other RV. Due to their design,small size and use as recreation,vacation and seasonal units,PMRVs are explicitly excluded from being considered or used as a manufactured home under the codes and regulations of the U.S. Department of Housing and Urban Development(HUD)specifically because they are a type of recreation vehicle(Title 24 §3282.8(g)). Park model RVs are built in accordance with the national safety standards set forth under a nationally recognized standard,the American National Standards Institute(ANSI)A119.5 Standard,not the HUD requirements that manufactured homes are mandated to comply with. The key distinction is that manufactured homes are single-family dwellings that are designed and built for permanent residency under standards set by the Department of Housing and Urban Development. Park models RVs,as noted,are designed and built to be used by families as a recreational, camping,or seasonal accommodation. PMRVs are not intended for,nor should they be used for,anything other than recreational camping or seasonal use.They are not permanent residences and should never be used as such. Like RV motor homes,travel trailers and fifth-wheel trailers,park model RVs are built to ensure safety but are not required to meet the building codes or installation codes that stick-built or manufactured homes are required to meet. Although they are sometimes stabilized and/or skirted,they are designed to remain on their axles and wheels,ready for movement and are not connected to the ground by footers, foundations,or columns(some local units of government do require them to be anchored to the ground due to excessive local winds,but even then they can easily be detached in minutes with only hand tools). PMRVs are not housing. There is no practical difference in the use of PMRVs than travel trailers or fifth-wheel trailers. They are not`improvements'to campgrounds any more than a travel trailer placed and used in a campground is.They are simply one choice among many in the RV camping environment.
