Subject: P.R. No. 19111 -
Please find attached P.R. No. 19111 requested by Councilmember
Lewis . Councilmember Lewis has requested a Charter Change for the
November 2015 Election. Councilmember Lewis has requested the
following changes stated below:
Option 1 : Positions 7 and 8 , pure at large and elected by a
plurality. The top two vote receivers will serve . Councilmember
Lewis states that the intent is to give any minority group a
reasonable opportunity to elect some one of their choice by one
shot (Anglo, Hispanic, Asian or others . )
Option 2 : Removal of Positions 7 and 8 . Councilmember Lewis
states that the intent is that this will delete duplication of
Districts 5 and 6 and save tax dollars .

RESOLUTION NO.
A RESOLUTION PROVIDING FOR THE SUBMISSION OF PROPOSITIONS
AS TO WHETHER OR NOT THE CITY CHARTER SHALL BE AMENDED
(REQUESTED BY COUNCILMEMBER LEWIS)
WHEREAS, pursuant to Section 9 . 004 Texas Local Government
Code, the City Council may on its on motion submit proposed charter
amendments to the municipality' s qualified voters of the City of
their action thereupon; and
WHEREAS, Councilmember Lewis has requested the following
options be considered as propositions to be submitted for voter
consideration:
Proposition 1: Shall Article II, Sections 1 and lA of the
Charter be amended as delineated below?
"Section 1. Number, Selection and Term of Office.
The Council shall be composed of a Mayor and Eight (8)
Councilmembers, each of whom, unless sooner removed under the
provisions of this Charter, shall serve as delineated herein. The
Mayor shall be elected at-large by the qualified voters of the
City. The Mayor shall be elected by majority vote and may reside in
any District. Councilmembers from Districts 1 through 6 shall be
elected by majority vote of the qualified voters of their
respective Districts. One (1) Councilmember for Position Number
Seven (7) and One (1) Councilmember for Position Number Eight (8)
shall be elected as delineated in Section 1A.
After May 2013, neither the Mayor nor any Councilmember shall
serve more than two (2) consecutive three (3) year terms in the
same office. This provision will apply to those newly elected to
the positions of Mayor and Council that take office after the May
2013 Election.

Section 1A. Council Positions 7 and 8 :
Until May 2017, Council Positions 7 and 8 shall have three (3)
year terms. The elections of Council Positions 7 and 8 shall be in
the year 2017 and thereafter by a plurality vote. Council Positions
7 and 8 shall be purely at-large and candidates may live anywhere
in the City of Port Arthur. The two top vote recipients in an
election for these purely at-large positions will serve in Council
Positions 7 and 8 . Council Positions 7 and 8 shall have two (2)
year terms. They shall not serve more than three (3) consecutive
two (2) year terms in the same office. This provision supersedes
any conflicting portion of the City Charter in relation to the
election of Council Positions 7 and 8 ."
Proposition 2 : Shall Article II, Sections 1 and lA of the
Charter of the City of Port Arthur be amended to remove
Councilmember for Positions 7 and 8?
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1 . That the facts and opinions in the preamble are
true and correct .
Section 2 . That as required by Section 52 . 072 of the Texas
Election Code, said amendments shall appear on the ballot as
propositions and inserted in the election ordinance .
Section 3 . That a copy of the caption of this Resolution
shall be spread upon the Minutes of the City Council .
READ, ADOPTED, AND APPROVED, this day of
2015 AD, at a Regular Meeting of the City Council of the City of
Port Arthur, Texas by the following vote : AYES :
