WATER TANKTO: FROM: DATE: SUBJECT: MEMORANDUM CITY OF PORT ARTHUR UTILITY OPERATIONS DEPARTMENT Steve Fitzgibbons, City Manager Daniel Shepherd, Director of Utility Operations January 15, 2002 Proposed Resolution No. 11630 COMMENTS RECOMMENDATION: I recommend that the City Council approve Proposed Resolution No. 11630 executing Change Order No. One to the contract between the City and D & W Contractors, Inc., related to the repair and painting of the Procter Street Extension Elevated Water Tank. This change order decreases the contract amount by $10,900.00. BACKGROUND: In November, 2001, the City authorized D & W Contractors, inc. to repair and repaint the Procter Street Extension Elevated Water Tank. Blast cleaning has been done that allowed the contractor to more closely inspect the water tank. This change order deletes some repair work that is not required but was included in the specifications. BUDGET/FISCALEFFECT: This change order decreases the contract amount by $10,900 to $152,647.00. STAFF/EMPLOYEE EFFECT: No anticipated effect on staffing. SUMMARY: I recommend that the City Council approve Proposed Resolution No. 11630 authorizing execution of Change Order No. One to the contract with D & W Contractors, Inc. /Id "llememl~er, we are here to serve the citizens of 1~o*'1./~'1~''' P.R. No. 11630 01/15~O2/Id RESOLUTION NO. A RESOLUTION APPROVING CHANGE ORDER NO. ONE TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND D & W CONTRACTORS, INC, RELATED TO THE REPAIR AND PAINTING OF THE PROCTER STREET EXTENSION ELEVATED WATER TANK IN THE CITY OF PORT ARTHUR, TEXAS. (DECREASES THE CONTRACT AMOUNT BY $10,900) ACCOUNT NO. 419-1622-531.85-00, PROJECT NO. 419102. WHEREAS, the City Council of the City of Port Arthur has awarded the contract for the repair and painting of the Procter Street Extension Elevated Water Tank to D & W Contractors, Inc., in Resolution No. 01-323; and, WHEREAS, Don S. Reichle & Associates, Inc., as owner's representative, has reviewed and recommends approval of Change Order No. One, copy attached hereto and made a part hereof as Exhibit "A", deleting repair work not required; for a total contract deletion of $10,900; NOW THEREFORE,~BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager be authorized to execute Change Order No. One (Exhibit A) to the referenced contract, deleting unnecessary repairs; and, THAT the total contract amount to be adjusted will be from Qne Hundred Sixty-three Thousand Five Hundred Forty-seven and 00/100 dollars ($163,547.00) to One Hundred Fifty-two Thousand Six Hundred Forty-seven and 00/100 dollars ($152,647); and, THAT no other conditions or covenants of the contract are changed or waived by this Change Order; and, THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council. 01/15/02/Id Page 2 of 2 READ, ADOPTED AND APPROVED THIS day of 2002 at a Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: AYES: Mayor Councilmembers NOES: Oscar Ortiz, Mayor ATTEST: Carolyn Dixon, City Secretary APPROVED AS TO FORM: Mark Sokolow, City Attorney APPROVED: Steve Fitzgibbons, City Manager ~1 Shepher~ctor of Utility Operations CHANGE ORDER FORM DATE: January 2, 2002 AGREEMENT DATE: NAME OF PROJECT: Tank OWNER: City of Port Arthur Exhibit Page I of 2 November 13, 2001 Repair & Paint Procter St. Extension Elevated Water CONTRACTOR: D & W Contractors, Inc. Contractor's acceptance of Change Order relieves the City of any liability for additional costs incurred by Contractor in his performance of the work covered by the Change Order.
