No. 5243 February l3, 2002 RECOMMENDATION It is recommended that the City Council approve Proposed Ordinance No. 5243 amending a Construction and Maintenance Agreement with the Texas Department of Transportation for the widening of 9th Avenue from State Highway 73 to Lake Arthur Drive which would authorize an increase of $43,380.78 for additional drainage work for a new total of $981,414.97. Funds are available in Account No. 301-1601-591.86-00, CIP 801 or other accounts in which balances ~-emaln. BACKGROUND The City of Port Arthur submitted an application for and was successful in receiving funds from the Texas Department of Transportation to widen 9th Avenue from State Highway 73 to Lake Arthur Drive. A Construction and Maintenance Agreement in the amount of $938,034.19 for the City's share, was approved by the City Council on August 22, 2000. The $43,380.78 increase is for additional drainage work necessitated by the City's 6 waterline not being relocated, due to potential problems in doing so, between Station 93+87 and Station 106+66.04. The City's share of the Agreement is being amended to allow for the cost of the additional drainage work. BUDGET/FISCAL EFFECT Funds are available in Account. No. 301-1601~591.86-00, CIP 801 or other accounts in which balances remain. STAFFING/EMPLOYEE EFFECT None. AN ORDINANCE AMENDING A CONSTRUCTION AND MAINTENANCE AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE WIDENING OF 9TM AVENUE FROM STATE HIGHWAY 73 TO LAKE ARTHUR DRIVE WHICH WOULD AUTHORIZE AN INCREASE OF $43,380.78 FOR ADDITIONAL DRAINAGE WORK FOR A TOTAL CITY SHARE OF /[981,414.97. FUNDS ARE. AVAILABLE IN ACCOUNT NO. 301-1601-591.86-00, CIP 801 OR OTHER ACCOUNTS IN WHICH BALANCES REMAIN. WHEREAS, the City of Port Arthur submitted an application for and was successful in receiving funds from the Texas Department of Transportation to widen 9th Avenue from State Highway 73 to Lake Arthur Drive; and, WHEREAS, the City's share of the project has been $1,108,034.10 which is inclusive of the design agreement ($170,000), and the construction and maintenance agreement ($938,034.19) and these funds have been previously forwarded to the Texas Department of Transportation; and, WHEREAS, an increase of $43,380.78 is required in the City's share of the construction and maintenance agreement to allow additional drainage work necessitated by the City's 16~ waterline remaining in place due to operational concerns between Station 93+87 and Station 106+66.04; and, WHEREAS, a breakdown of the increased cost is attached hereto and made a part hereof as Exhibit "A~; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR TEXAS: THAT the $43,380.78 increase is for additional drainage work necessitated by the City's 16' waterline not being relocated, due to potential problems in doing so, between Station 93+87 and Station 106+66.04; and, THAT the City Council of the City of Port Arthur hereby authorizes an Amendment to the existing Construction and Maintenance Agreement with the Texas Department of Transportation to increase the City's share of the Agreement by $43,380.78 to a new total of $981,414.97; and, THAT funds are available in Account No. 301-1601-591.86-00, CIP 801, or other accounts in which balances remain, for the City's additional $43,380.78 cost for the project; and, THAT a certified copy of this Ordinance shall be forwarded to the Texas Department of Transportation's' District 20 office; and, THAT a copy of the caption of this Ordinance be sptiad upon the Minutes of the City Council. The work shall not exceed $43,380.78. The work will be handled by force account (Item 9 of the Standard Specifications for Construction of Highways, Streets and Bridges, 1993). The work will consist of man- hours, material, and equipment. Since ROW is said clear by the City of Port Arthur, we ask that the City of Port Arthur fund the total cost. Please review and reply.
