RECOMMENDATION:
I recommend that Proposed Resolution No. 11683 be approved. This Resolution would
authorize the City Manager to sign an amendment to our existing grant agreement with
the Texas Department of Transportation for funding for transit operations.
BACKGROUND:
The Texas Department of Transportation had previously approved a grant in the amount
of $225,000 for operating assistance for the Port Arthur Transit System. This amount
was approved pending a final determination of the amount of funding that would be
available to the City over the Biennium for transit funding. This final allocation was
determined to be $776,487. I am recommending an allocation of $465,900 for the first
year and $310,587 for the second. Any funds remaining at the end of the first year may
be rolled over into next years agreement containing the $310,587.
BUDGETARY/FISCAL EFFECT:
Provides additional assistance for operation of the transit system.
STAFFING/EMPLOYEE EFFECT:
None
SUMMARY:
I recommend approval of Proposed Resolution No. 11683 authorizing the City Manager
to execute a amendment to a grant agreement with TXDOT providing additional funds to
Port Arthur Transit for operating assistance.

A RESOLUTION AUTHORIZING EXECUTION OF
AMENDMENT NO. 1 TO GRANT AGREEMENT NO.
URB-0202 (20) WITH THE TEXAS DEPARTMENT
OF TRANSPORTATION FOR TRANSIT
OPERATING FUNDS
WHEREAS, the City of Port Arthur is eligible as a 49 U.S.C. 5307 provider for state
f'mancial assistance to be used to provide transportation services; and,
WHEREAS, the City of Port Arthur has an existing grant agreement with the Texas
Department of Transportation for $225,000 in operating funds; and,
WHEREAS, the Texas Department of Transportation has approved our request to amend our
agreement to increase the maximum reimbursable amount to $465,900; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT the City Manager is hereby authorized to execute Amendment No. 1 to Grant
Agreement No. URB-0202 (20) between the State of Texas, acting by and through the Texas
Department of Transportation and the City of Port Arthur for £mancial assistance, a copy of said
amendment being attached hereto as Exhibit "A".
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

STATE/LOCAL PUBLIC TRANSPORTATION GRANT AGREEMENT
AMENDMENT #1
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of
Transportation, hereinafter called the "State", and the City of P.ort Arthur, hereinafter called the "Subreceipent".
WITNESSETH
WHEREAS, the State and the Subrecipient executed a contract on September 10, 2001 to effectuate their agreement to
provide for the expenditure of funds pursuant to the provisions of 49 U.S.C., § 5307, for a transportation project in an
urbanized area of the state; and,
WHEREAS, it has become necessary to amend that grant agreement;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto,
the State and the Subrecipient do agree as follows:
AGREEMENT
Article '1. Description of Amended Items:
Article 3A, page 2, sentence 1 is revised to read "The maximum amount payable under this agreement without
modification is $ 465,900. Exhibit A attached hereto is the revised project budget and shall replace the budget included
with the above-mentioned Grant.
All other provisions of the original grant agreement are unchanged and remain in full force and effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the
organization they represent.
IN WITNESS WHEREOF, THE STATE AND THE SUBREClPIENT have executed duplicate counterparts to effectuate
this agreement.
