No. 19156 9/21/15 jt ort r•thur - Texas INTEROFFICE MEMORANDUM UTILITY OPERATIONS DEPARTMENT-ADMINISTRATION Date: September 21, 2015 To: Brian McDougal, City Manager From: Jimmie Johnson, Ph.D., Director of Utility Operations RE: Proposed Resolution No. 19156 Nature of the Request: That City Council approve Proposed Resolution No. 19156 acknowledging the acceptance of the Engineer's Certificate of Substantial Completion, and Change Order Number One (1), for the Port Acres WWTP Centrifuge Improvements with L&L General Contractors, of Beaumont, Texas. This is a Hurricane Recovery Grant administered by the Texas General Land Office which has funded this project. This project was to install and furnish a new Centrifuge at the Port Acres WWTP along with equipment, electrical, and foundation. This will give us a second centrifuge at this facility for the dewatering of sludge and will improve our ability to manage the excess amounts. Staff Analysis, Considerations: Staff will operate centrifuge to control buildup of sludge at the Port Acres WWTP. Recommendation: I recommend that the City Council approve Proposed Resolution No. 19156 acknowledging the acceptance of the Engineer's Certificate of Substantial Completion, and Change Order Number one (1). For the Port Acres WWTP Centrifuge Improvements with L&L General Contractors, of Beaumont, Texas. Budget Considerations: This project will be funded through the GLO Project No. I21 WWI, 144-1201-532.59-00. P. R. No. 19156 09/21/15jt RESOLUTION NO. A RESOLUTION ACCEPTING THE ENGINEER'S CERTIFICATE OF SUBSTANTIAL COMPLETION, AND AUTHORIZING CHANGE ORDER NO. 1 TO THE CONTRACT WITH L & L GENERAL CONTRACTORS AND GLO CHANGE ORDER NO. 1, INCREASING THE CONTRACT AMOUNT BY $2,000.00 FOR ADDITIONAL WORK TO COMPLETE THE PORT ACRES WWTP CENTRIFUGE IMPROVEMENTS, PROJECT NO. 121WWI, 144-1201-532.59-00. WHEREAS, per Resolution No. 14-309, the City entered into a contract for the installation of the Port Acres WWTP Centrifuge Improvements Project with L&L General Contractors for the contract amount of$534,000.00; and, WHEREAS, during the course of the work, Arceneaux Wilson & Cole determined that additional work to relocate a sludge line was needed in order to continue construction; and, WHEREAS, the engineer recommends proposed Change Order No. 1 with L&L General Contractors and GLO Change Order No. 1, in the amount of $2000.00 attached as Exhibit"A", to accomplish this work; and, WHEREAS, the Engineer's Certificate of Substantial Completion date of May 29, 2015 applies to all work under the contract documents or to the following specified parts thereof, between the City of Port Arthur and L&L General Contractors; and, WHEREAS, on May 29, 2015 the work which this certificate applies has been inspected by Arceneaux Wilson & Cole, the Utility Operations Department and L&L General Contractors, and is hereby declared to be substantially complete in accordance with the Contract Documents (attached as Exhibit"B"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P. R. No. 19156 09/21/15jt Page 2 THAT, the City Council hereby accepts the Engineer's Certificate of Substantial Completion for Port Acres WWTP Centrifuge Improvements Project with L&L General Contractors, in the total amount of $536,000.00, a contract term of 280 days, with a contract completion date of July 19, 2015; and, THAT, Arceneaux Wilson & Cole Consulting Engineers, and L&L General Contractors will submit a Certificate of Completion, Contractors Certificate of Release and final payment for the contract after the punch list has been completed for City Council approval; and, THAT, the Acceptance by the CONTRACTOR of final payment shall be and shall operate as a release to the OWNER of all claims and all liability to the CONTRACTOR for all things done or furnished in connection with this work and for every act and neglect of the OWNER and others relating to or arising out of this work. No payment, however, final or otherwise, shall operate to release the CONTRACTOR or his Sureties from any obligations under this Contract or the Performance and Payment Bonds; and, THAT, the City Manager is authorized to execute Change Order No. 1 between the City of Port Arthur and L & L General Contractors, and Change Order No. 1 with the GLO for the Port Acres WWTP Centrifuge Improvements, in substantially the same form as attached hereto as Exhibit"A"; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
