No. 19167—Calling for a Public Hearing Nature of the request: Attached is P.R. No. 19167 calling for a public hearing to consider a proposed abandonment for 0.0459 acre of land consisting of a 20' x 100' private utility easement owned by the Hughen Center, Inc. The property is located within Tracts 1-A and 1-B, Block 12, Town of Griffing, in Port Arthur, Texas. The purpose of this request is for the construction of additional classroom for The Hughen Center, Inc. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A PROPOSED ABANDONMENT FOR 0.0459 ACRE OF LAND CONSISTING OF A UTILITY EASEMENT LOCATED WITHIN TRACTS 1-A AND 1-B, BLOCK 12, TOWN OF GRIFFING, CITY OF PORT ARTHUR,JEFFERSON COUNTY, TEXAS A15-02 (THE HUGHEN CENTER,INC.) WHEREAS, the applicant—The Hughen Center, Inc., is requesting that the City of Port Arthur consider this abandonment for the area delineated in Exhibit"A"; and, WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to consider the abandoning, vacating and relinquishing streets, alleys and easements; and, WHEREAS,the City Council has the authority to vacate, abandon or close a street under Section 311.001 and 311.007 Transportation Code; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That the Planning and Zoning Commission heard this case on September 21,2015. SECTION 3. That upon abandoning and vacating the alleys, the City shall have the right, if it so desires,to retain utility easements. SECTION 4. That a public hearing to consider whether to grant the applicant the abandonments as delineated in Exhibit"A" shall be held on November 10, 2015 at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall,444 Fourth Street. That notice of the public hearing shall be published at least fifteen (15) days before the date of the hearing in the official newspaper of the City pursuant to 211.006 of the Texas Local Government Code. SECTION 6. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council.
