A RESOLUTION REQUESTING APPROVAL OF THE UPDATED TITLE VI
PROGRAM 2015-2018 AS REQUIRED BY THE FEDERAL TRANSIT
ADMINISTRATION (FTA) REGARDING POLICIES AND PROCEDURES AS
OUTLINED IN THE CIVIL RIGHTS ACT OF 1964.
WHEREAS,pursuant to the Civil Rights Act of 1964, the City of Port Arthur Transit
Department is required every three (3) years to submit an updated Title VI Report to the
Federal Transit Administration (FTA) attached hereto as Exhibit"A"; and,
WHEREAS, in compliance with the rules and regulations set forth by the Federal Transit
Administration (FTA), the City of Port Arthur Transit Department has updated its Title VI
Program for the calendar years of 2015-2018.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct.
THAT,the City Council approves the updated policies and procedures of the Title VI
Program of the Civil Rights Act of 1964 as mandated by the Federal Transit Administration
(FTA), in substantially the same form as attached hereto as Exhibit"A".
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

Introduction
In compliance with Title VI of the Civil Rights Act of 1964,the City of Port Arthur Transit
Department(PAT)provides public transportation without regard to race, color, or national
origin. Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race,
color, or national origin in programs receiving federal financial assistance.
Policy Statement
The City of Port Arthur Transit Department in compliance with Title VI of the Civil Rights Act
of 1964 prohibits discrimination on the basis of race, color, or national origin in programs and
activities receiving federal financial assistance. Anyone who believes that they have been subject
to an unlawful discriminatory practice by Port Arthur Transit has the right to file a complaint
with the City of Port Arthur Title VI Coordinator. Formal complaints should be in writing and
mailed to: City of Port Arthur Transit Department, P.O. Box 1089, Port Arthur, Texas 77641.
Title VI Complaint Procedures
Port Arthur Transit(PAT)has a standard process for investigating all complaints. Anyone who
believes that they have been subject to an unlawful discriminatory practice by Port Arthur
Transit has the right to file a complaint with the City of Port Arthur Title VI Coordinator.
Anyone who has a discrimination complaint should contact Port Arthur Transit at
(409)983.8730. Port Arthur Transit will investigate the allegation by requesting additional
information for the purpose of obtaining an appropriate resolution. Upon completion of the
Investigation PAT will contact you by certified mail no less thirty (30)working days in response
to the alleged offense. Anyone may file a signed, written complaint within 180 days from the
date of the alleged discrimination. At a minimum,the complaint should include the following
information
• Name, mailing address, and contact information(i.e.,telephone number, email address,
etc); and,
• How, when, where and why complainant alleges they were discriminated against; and,
• Names and contact information of any witnesses; and,
• Any other significant information.

Title VI Investigations, Complaints, or Lawsuits
Port Arthur Transit has not received any formal Title VI complaints during the current reporting
period,nor have there been any transit-related investigations, lawsuits, or complaints against Port
Arthur Transit that allege discrimination on the basis of race, color, or national origin.
Notification of Port Arthur Transit Title VI Obligations
Port Arthur Transit publicizes its Title VI program by posting its commitment to providing
services without regard to race, color, or national origin. The Port Arthur Transit Title VI Public
notice shown below is posted on all Port Arthur Transit buses, and Port Arthur Transit facilities.
The public notice is also included on the City of Port Arthur and the Port Arthur Transit
websites. If you feel you have been discriminated against and wish to request information on
how to file a formal complaint, you may do so by contacting the Title VI Coordinator at
409.983.8730, or in writing at 344 Procter Street. Port Arthur Transit will respond and
acknowledge receipt of your complaint at which time a formal investigation will begin.

Analysis of Construction Projects
Since the last Title VI submission, PAT has initiated and completed several Transit projects
including; the renovation of the Transit Service Center,the construction of an Automatic Bus
Wash Facility, and the completion of the new Transit Administration Building.
Subrecipients
The City of Port Arthur Transit Department has no subrecipients.
Minority Representation on Planning and Advisory Bodies
Currently, PAT has no Planning or Advisory Bodies. However,plans are being finalized for a
Paratransit eligibility board which will include members of various ethnicities of the city.
Outreach in procuring such a board will come from human services organizations within the
community.

Limited English Proficiency (LEP) Plan
Introduction
The purpose of this Limited English Proficiency(LEP) Plan for the City of Port Arthur is to
clarify the responsibilities of recipients of federal financial assistance for the operation of its
public transit system, as they relate to the needs of individuals with limited English language
skills. This plan has been prepared in accordance with Title VI of the Civil Rights Act of 1964
which prohibits discrimination on the basis of race, color, or national origin in programs and
activities receiving Federal financial assistance. Executive Order 13166 titled "Improving
Access to Services for Persons with Limited English Proficiency", indicates that differing
treatment based upon a person's inability to speak, read, write, or understand English is a type of
national origin discrimination. This order applies to all state and local agencies which receive
federal funds, including the City of Port Arthur's Transit which receives federal assistance
through the Federal Transit Administration(FTA) and the Texas Department of Transportation
(TxDOT).
Plan Summary
Port Arthur Transit(PAT) has developed this Limited English Proficiency(LEP)Plan to help
identify reasonable steps to provide language assistance for LEP persons seeking meaningful
access to PAT services. As defined in Executive Order 13166, LEP refers to persons for whom
English is not their primary language and who have a limited ability to read, speak, write or
understand English. It includes people who reported to the U.S. Census that they speak English
less than very well, not well, or not at all.
This plan outlines how to identify a person who may need language assistance, the ways in
which assistance may be provided, staff training that may be required, and how to notify LEP
persons that assistance is available. In order to prepare this plan, PAT undertook the FTA's four-
factor LEP analysis which considers the following factors:
1. The number and proportion of LEP persons in the service area who may be served or,
are likely to be served by PAT.
2. The frequency with which LEP persons come in contact with PAT's services.
3. The nature and importance of PAT's services to the LEP population.
4. The resources available to PAT and overall cost to provide LEP assistance.

Four-Factor Analysis
(All information provided is based on the US Census data from 2010)
1. The number and proportion of LEP persons in the service area who may be served or, are
likely to be served by PAT.
PAT provides service within the City of Port Arthur. The Metropolitan planning services are
provided by Southeast Texas Regional Planning Commission(SETRPC). US Census data from
2010 was used to determine the LEP population.

*Note*PAT will provide written notice(free of charge) in Vietnamese and Spanish for a
competent oral interpretation of assistance available.
2. The frequency with which LEP individuals come in contact with PAT services.
PAT assesses the frequency at which staff and drivers encounter LEP persons.This assessment
includes; documenting phone inquiries, and verbally surveying drivers. Since 2011,PAT has had
zero(0)request for an interpreter, and zero(0)request for translated PAT documents. PAT
provides vital routes and scheduling information in Spanish,Vietnamese and Braille. The staff
and drivers have had little to no contact with LEP individuals.
3. The nature and importance of PAT's services to the LEP population.
PAT is committed to providing updated information regarding fixed-route, and Paratransit service
to LEP persons. If limited English is a barrier to using the bus system, adverse affects could be
serious which could include; limited access to employment, education,health care, and any other
information vital to LEP persons for the purpose of livelihood. PAT's services include;route and
schedule information, detour information,fare and payment information,passenger information,
information on how to ride,public service announcements, safety and security announcements,
passenger comment cards,and transit planning information.
4. The resources available to PAT and overall cost to provide LEP assistance.
PAT assessed all available resources that could be used for providing LEP assistance. The
assessment included;the cost of a professional interpreter and translation service cost on an as
needed basis,which documents would be most valuable translated, identifying organizations
available to partner with PAT for outreach and translation efforts, and what level of staff training
is needed(i.e. audio equipment and booklets may cost an average of$100 if already translated.
However, in house translators would calculate a savings of$80 to $100 per hour based on the
type of translation required). When considering the needs of one individual for verbal or paper
translation would cost approximately$200 to $250 per hour.

Limited English Proficiency (LEP) Plan
The need for LEP assistance in the PAT service area is very low, however the following
language assistance measures can be provided in order to gain better access to LEP persons.
Language Assistance Measures
Language Identification Cards
PAT will determine the language of LEP individuals by requesting information with the use of Language
Identification Cards,or,"I Speak Cards". PAT will document the LEP individuals served each year and
determine their preferred national language if communication in English is a barrier to receiving PAT
services.
Free LEP Assistance Request/Notice
PAT will inform passengers that LEP Assistance is available to them free of charge. PAT will place
notice on its website, buses(fixed-route and Paratransit)bus schedule,the information board in the
terminal, public service announcements, passenger comment cards, and transit planning information.
Also, all PAT vehicles(fixed-route and Paratransit)are equipped with Basic Spanish/Vietnamese
booklets for transit employees.
• PAT will provide interpreters/translator to ensure that he or she can communicate
effectively in both English and the other language;
• PAT will translate policies and procedures in the language LEP individuals can
comprehend.
Survey LEP Persons
Surveys are available for LEP persons to complete through PAT's website.PAT will communicate this
survey through the Southeast Texas Regional Planning Commission(SETRPC), and the daily ridership
log in order to receive input from LEP persons accessing services throughout the Port Arthur community.
Safe Harbor Provision
Port Arthur Transit is committed to providing language assistance to all persons within the city who are
LEP.However,based on the data provided in the Four Factor Analysis,there are no single areas within
our service boundaries that meet the Safe Harbor Threshold. The Safe Harbor Provision stipulates that, if
a recipient provides written translation of vital documents for each eligible LEP language group that
constitutes five percent(5%)or 1,000 persons,whichever is less, of the total population of persons
eligible to be served or likely to be affected or encountered,then such action will be considered strong
evidence of compliance with the recipient's written translation obligations. Translation of non-vital
documents, if needed,can be provided orally. If there are fewer than 50 persons in a language group that
reaches the five percent(5%)trigger,the recipient is not required to translate vital written materials but
should provide written notice in the primary language of the LEP language group of the right to receive
competent oral interpretation of those written materials, free of cost. These Safe Harbor provisions apply
to the translation of written documents only. They do not affect the requirement to provide meaningful
access to LEP individuals through competent oral interpreters where oral language services are needed
and are reasonable. A recipient may determine,based on the Four Factor Analysis,that even though a
language group meets the threshold specified by the Safe Harbor Provision,written translation may not be
an effective means to provide language assistance measures. For example, a recipient may determine that
a large number of persons in that language group have low literacy skills in their native language and
therefore require oral interpretation.

Website Translation
Currently, PAT is working with the City of Port IT Department to implement Google Translate
on PAT's website. The website will allow anyone to click a drop down button to change the
language on the site to their native language. PAT will provide website information in a
translatable format.
Monitoring,Evaluate, and Updating the LEP Plan
The LEP Plan will be reviewed and updated each year(if needed) and will include the following
information: PAT LEP requests will be documented by ridership of those persons and will
include the following:
• The number of LEP persons encountered;
• The use of interpretive language services;
• The needs of a LEP person and how those needs were addressed;
• The LEP person's needs for service have changed.
*Note* LEP request will be handled immediately upon notification and will be
addressed by the Title VI Coordinator.
Staff Training for LEP Persons
The following training will be provided to PAT staff:
• Current Port Arthur Transit staff will be trained on the LEP Plan, the Title VI program
and complaint procedures;
• New and current Transit staff will be trained on how to communicate with the LEP
population, and proper procedures should communication difficulties arise;
• All staff will be trained to deal with LEP instances on the bus, and in the office;
• All staff will be trained on how to handle requests for interpretive services through public
meetings to be conducted annually.

Fixed Route Service Standards and Policies
1. Vehicle load for each mode (Service Standard)
PAT buses have a capacity load total forty four(44)passengers
(thirty two (32) seats and can accommodate twelve (12)passengers standing).
2. Vehicle Headway for each mode (Service Standard)
PAT's Headway for each mode is one (1) hour.
3. On-time performance for each mode (Service Standard)
PAT uses checkpoint times and transfer points to help calculate time performance;
PAT's on-time performance is ninety-two (92%).
4. Service availability for each mode (Service Standard)
PAT's bus stop service averages two (2)to three (3) blocks apart.
5. Distribution of Transit amenities for each mode (Service Policy)
Transit amenities are equitably distributed on a system wide basis. Port Arthur Transit
has authority over bus stop improvements and amenities within the city. Bus stops
located in the city of Port Arthur will be allocated based on ridership activity (total
number of average daily boarding's) and will be equitably distributed to reflect the
system wide demographics of the city of Port Arthur. Ridership activity levels are of
medium volume and average 50 riders or less.
6. Vehicle assignment for each mode (Service Policy)
Paratransit Mode
All Paratransit vehicles are body on chassis vehicles with wheel chair lifts. They are
Assigned as needed to maintain customer service needs. Port Arthur Transit provides
door-to-door service for our disabled citizens.
Fixed Route Mode
Port Arthur Transit's policy with respect to vehicle assignment is depot.
Port Arthur Transit fixed route mode of service consists of 35 foot motor coaches. These
buses are assigned among routes that use local streets. Buses are assigned among routes
to maintain fleets on each route with an average mileage and age that does not exceed the
system wide average. Port Arthur Transit provides service to 90% of the city. Routes
serve all the major areas including four(4) senior citizen complexes and all low to
moderate income housing complexes. Additionally, PAT serves all shopping malls and
employment sites.

Port Arthur Transit (PAT) Public Participation Plan
Introduction
The Public Participation Plan(PPP) is a guide for Port Arthur Transit's ongoing public
participation efforts. Its purpose is to ensure that PAT utilizes effective means of providing
information and receiving public input on transportation decisions from low income, minority
and Limited English Proficient(LEP)populations, as required by Title VI of the Civil Rights Act
of 1964, and its implementing regulations. Under federal regulations, Transit Operators must
take reasonable steps to ensure that Limited English Proficient(LEP)persons have meaningful
access to their programs and activities. This means that public participation opportunities,
normally provided in English, is also accessible to persons who have a limited ability to speak,
read, write, or understand English. Port Arthur Transit's PPP will be a"working document"that
may be updated periodically to reflect community preferences, changing demographics and
transit services, as well as respond to new communication and outreach methods. Port Arthur
Transit(PAT) and the Metropolitan Planning Organization(MPO), also known as the Southeast
Texas Regional Planning Commission(SETRPC)provides for joint public participation within
the area, however PAT is committed to providing information to LEP persons by advertising:
• Notices on PAT's website@ www.portarthur.net/transit;
• Advertisement in the daily newspaper(Port Arthur News) of scheduled public meetings
with date and times;
• Notices of public meetings posted on all transit vehicles and inside the transfer facility;
• Create and distribute surveys to PAT riders with special emphasis on the LEP population;
• Public Service Announcements on the local public access channel;
• Translation and interpretive services available upon request;
• Port Arthur Transit will continue to coordinate LEP outreach efforts with the Southeast
Texas Regional Planning Commission(SETRPC) for the purpose of informing LEP
individuals of how to access PAT's services.

Denials/Refusal,Safety and Security,and Public Hearing matters;and
WHEREAS,the City of Port Arthur Transit will become compliant in this respect as to
addressing deficiencies noted after the Triennial 2012 review response given in November that policies
and training will be completed;and
WHEREAS,approval of these policies by the City Council reveal that corrective action and
implementation of the updated or new policies and training are supported and approved by the City,and
the Federal Transit Administration;and
WHEREAS,attached are the policies on Sensitivity Training submitted regarding the ADA.The
Trip Denial and Refusal Procedures,Public Hearings on fare increases,and the Safety and Security
procedures,attached in Exhibits"A", `B," "C"and"D"respectively;and
WHEREAS,these procedures are also in line with Title VI-Civil Rights policies;and
WHEREAS,the Federal Transit Administration(FTA)requires that all policies shall be
approved,distributed and implemented to be in compliance with MAP-21.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
THAT,the facts and opinions submitted in the preamble are true and correct.

THAT,the City Council hereby approves the implementation of said policies on ADA
challenges,Trip Denial/Refusal Policies,Safety and Security Procedures,and Public Hearings.
THAT,as exhibits"A," "B," "C,"and"D" are required by MAP-21 to comply with FTA
mandates and training in substantially the same form as attached as"PAT's request for PR 17480 be
approved with regards to implementation.
THAT,a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
