Manager and the City Attorney's office to do all things
necessary to execute the settlement of the City's
Intervention in Cause No. A-162,921; Linda Bates vs.
Norris Louviere. We will discuss this matter in
Executive Session.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
AND THE CITY ATTORNEY'S OFFICE TO DO ALL
THINGS NECESSARY TO EXECUTE THE
SETTLEMENT OF THE CITY'S INTERVENTION IN
CAUSE NO. A-162,921; LINDA BATES VS. NORRIS
LOUVIERE
WHEREAS, City has Intervened in Cause No. A-162,921, Linda Bates vs. Norris
Louviere in the 58th Judicial District Court, Jefferson County, Texas for recovery of its
worker's compensation liens for both Linda Bates, Plaintiff, and Dorothy Joseph, passenger,
arising from a June 4, 1998 automobile accident involving these two individuals who were
City employees at the time of the accident; and
WHEREAS, the City of Port Arthur has paid $12,213.79 in worker's compensation
and $20,165.01 in medical for Linda Bates; and
WHEREAS, the City of Port Arthur has paid $16,958.98 in worker's compensation
and $11,447.32 in medical for Dorothy Joseph; and
WHEREAS, this matter is on the April trial docket and time is of the essence.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager is authorized to do all things necessary to execute
the settlement of the City's intervention and to accept payment as denoted in Exhibit "A" in
settlement of the City's worker's compensation liens resulting from the June 4, 1998

automobile accident involving City employees Linda Bates and Dorothy Joseph.
Section 3. That the City Manager is authorized to execute a release, subject to
approval by the City Attorney's office.
Section 4. That the City Attorney's office is authorized to do all things necessary
to settle the litigation.
Section 5. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.
