BACKGROUND The purpose of the contract amendment between the City of Port Arthur and Texas Department of Health is to promote implementation of effective tobacco use prevention and control programs in Port Arthur. Specific activities should include: * subcontracting with local community groups and organizations; * participating in community wide events; * increase awareness and educate the community on tobacco issues; * preventing initiation of youth tobacco use; * promoting cessation for current users of tobacco products; * protecting the public from involuntary exposure to environmental tobacco smoke; and, * decreasing tobacco use in at-risk priority population groups. An increase in funds will support the health department in performing these wide range of activities. The additional $61,314 will bring the total award to $128,314. The funds are used for personnel and fringe for two employees, to purchase supplies, travel, and to subcontract with local organizations. STAFFING/EMPLOYEE EFFECT: The grant funds two employees, a health educator and community service aide. SUMMARY: It is recommended that.the City Council adopt P.R. No. 11715, authorizing the City Manager to accept and execute a contract amendment between the City of Port Arthur and Texas Department of Health to increase funds to provide additional tobacco prevention and control activities to the citizens of Port Arthur. Cover Page 2 DOCUMENT NO. 7460018850-2002 ATTACHMENT NO. 05A PERFORMING AGENCY: PORT ARTHUR CITY HEALTH DEPARTMENT RECEIVING AGENCY PROGRAM: OFFICE OF TOBACCO PREVENTION AND CONTROL TERM: September01,.2001 THRU: August 31, 2002 It is mutually agreed by and between the contracting parties to amend the conditions of Document No. 7460018850 2002-05 as written below. All other conditions not hereby amended are to remain in full force and effect. SECTION I. SCOPE OF WORK: PROJECT 1 PERFORMING AGENCY shall distribute tobacco settlement funds to local community groups, organizations, and coalitions to conduct tobacco prevention and control activities as part of the tobacco prevention initiative developed by RECEIVING AGENCY. PERFORMING AGENCY staff shall work with RECEIVING AGENCY staff to provide technical assistance and training for funded projects, and shall provide city/county-level coordination for tobacco prevention and/or cessation initiative activities. Community groups, organizations, and coalitions receiving funding shall provide community, school, and/or cessation activities as outlined in the attached Exhibit A, focusing on prevention of youth tobacco use, protection of the public to environmental tobacco smoke (ETS), and elimination of disparities among diverse and special populations. PERFORMING AGENCY shall actively coordinate with Education Service Center staff and RECEIVING AGENCY staff working with schools on tobacco prevention activities. PERFORMING AGENCY shall actively involve youth in the planning and implementation of youth-oriented activities. PERFORMING AGENCY shall ensure that at least 33% of funding is used to conduct community and cessation activities for groups representing minority and diverse populations, including minorities, people in rural communities, the elderly, and gay communities. PERFORMING AGENCY shall cooperate with researchers contracted by RECEIVING AGENCY to evaluate the overall effectiveness of the Texas Tobacco Initiative Pilot Project and the current capacity of funded entities to implement tobacco-related initiatives. PERFORMING AGENCY shall actively coordinate with the media agency contracted by the RECEIVING AGENCY for media and public relations activities. ATTACHMENT - Page PERFORMING AGENCY shall coordinate at least one (1) event for TEXAS DUCK DAYS to b'e held between November 11-17, 2001. An event is defined as any public activity that involves 9-12 year olds in a manner that raises awareness of tobacco prevention issues using messages already identified by the Office of Tobacco Prevention and Control for this audience. PERFORMING AGENCY shall register their event(s) online at www.txduckdays, org or by faxing the information to the Information Specialist of the Office of Tobacco Prevention and Control at (512) 458-7240. PERFORMING AGENCY shall use DUCK and "Tobacco is Foul" images without any modification. PROJECT2 GOALS The purpose of this contract is for PERFORMING AGENCY to promote implementation of effective tobacco use prevention and control programs in Port Arthur, Texas. The goal is to achieve a 6% reduction in tobacco use in all funded areas per year through programs that: 1) Prevent initiation of youth tobacco use; 2) Promote cessation for current users of tobacco products; 3) Protect the public from involuntary exposure to environmental tobacco smoke (ETS); 4) Decrease tobacco use in at-risk priority population groups. The CDC Best Practices for Comprehensive Tobacco Control Programs, August 1999, specifies that community programs include activities which: increase the number of organizations and individuals involved in planning education and training programs; use state and local counter-marketing campaigns to place pro-health messages on tobacco control; promote the adoption of public and private tobacco control policies; and monitor program implementation. DIRECT PROGRAM DELIVERY PERFORMING AGENCY shall coordinate at least one (1) event for TEXAS DUCK DAYS to be held between November 11-17, 2001, and shall register the event(s) online at www.txduckdays.org or by faxing the information to the Information Specialist of the Office of Tobacco Prevention and Control at (512) 458-7240. ATTACHMENT - Page 2 PROGRAM RESPONSIBILITIES OF PERFORMING AGENCY WITH SUBCONTRACTORS PERFORMING AGENCY shall involve and make funds available to community groups or coalitions, which are representative of the ethnic, geographic and socio-economic diversity in Beaumont. Funds shall be used to conduct effective tobacco prevention and control activities as part of a comprehensive approach to community tobacco use prevention and cessation. PERFORMING AGENCY shall: 1) Provide training for subcontractors on tobacco use prevention and control and Texas tobacco laws. 2) Develop a memorandum of understanding for each subcontractor requiring it to perform the following functions and activities: Community Mobilization and Training Activities a) Actively participate in a county-wide anti-tobacco coalition or create a new coalition to carry out tobacco use prevention activities; b) Train and educate a minimum of eight (8) key leaders on tobacco issues including local tobacco control policies and ordinances and Texas tobacco laws. The key leaders may include city council members, civic leaders, religious/spiritual leaders, health professionals, minority community leaders, law enforcement, school officials and business leaders; Policy and Regulatory Activities c) Build support for stronger tobacco control policies and ordinances by conducting three (3) of the following environmental tobacco smoke (ETS) activities: · Conduct a campaign to educate communities on the benefits of smoke- free bars, ETS issues and provide tobacco education materials and resources; · Educate a minimum of five (5) work sites, including restaurants and bars, on ETS issues and provide tobacco education materials and resources; · Increase awareness and educate the community on local tobacco-free ordinances, and/or educate on the need for local ordinances for tobacco-free worksites and public areas; · Visit a minimum of ten (10) day care centers in the community to educate workers on the benefits of a smoke-flee environment and provide materials and resoumes; · Work with schools to educate parents on the dangers of ETS through activities that may include Parent-Teacher Associations, school nurses, and school counselors. Counter-marketing/Educational Activities d) Increase awareness and educate the community on key tobacco issues including ETS, tobacco use cessation, state and local tobacco laws and ordinances; e) Promote a tobacco-flee message at community events, such as fairs, dances, sporting events, cultural events; ATTACHMENT - Page 3 f) Counteract tobacco industry marketing and advertising in the community; g) Involve youth ages 9-18 in the planning and implementation of tobacco prevention activities, in collaboration with the schools and the Statewide Tobacco Education Program (STEP); h) Involve young adults, age 18-24, in tobacco control activities, through local institutions of higher learning, junior colleges, trade schools, recreational entities, and the workplace; i) Conduct at least one (1) major community tobacco prevention event (i.e. marking the Gmat American Smoke Out, Kick Butts Day, World No Tobacco Day, Duck Days), and coordinate the event with Tuerff-Davis, PERFORMING AGENCY'S advertising contractor; j) Promote community tobacco use cessation among adults and youth, through referrals to the Quitline and health cam providers, and educate providers, health cam organizations, and health insurers in accordance with the I-IHS Clinical Practice Guidelines on Treating Tobacco Use and Dependence (June 2000); k) Conduct media advocacy activities such as letter-writing campaigns, billboards created by local citizens, murals addressing tobacco issues, and activities directly involving youth. Administrative Functions I) Report activities to PERFORMING AGENCY on a quarterly basis; 2) Submit an action plan to PERFORMING AGENCY within one (1) month of receipt of contract describing how and when above activities am to be accomplished. NETWORKING AND COORDINATION RESPONSIBILITIES PERFORMING AGENCY shall: 1) Coordinate community activities with subcontractors, Office of Tobacco Prevention and Control (OTPC) regional and headquarters staff, Educational Service Center staff, and Tuerff-Davis to maximize the impact of the activities; 2) Maintain ongoing communication with the subcontractors to ensure timely delivery of information on area tobacco coalition activities; 3) Participate as an active member of the local tobacco control coalitions. ADMINISTRATIVE AND STAFFING RESPONSIBILITIES PERFORMING AGENCY: 1) Is responsible for ensuring that approximately one third (1/3) of the funding distributed to local community groups or coalitions is used toward activities that serve diverse and high-risk priority populations; 2) Will receive funding from RECEIVING AGENCY to staff one (I) FTE position to coordinate the distribution of funds to local community groups or coalitions, train staff and community members, provide technical assistance for funded projects, and provide updates and reports to RECEIVING AGENCY program regarding funded tobacco prevention activities. The staff shall participate in the RECEIVING AGENCY'S training activities and periodic coordinating activities; ATTACHMENT - Page 4 3) Shall cooperate with mseamhers contracted by RECEIVING AGENCY to evaluate overall effectiveness of the Texas Tobacco Project and the current capacity of funded entities to implement tobacco-related initiatives; 4) Shall review action plans of subcontractors and provide technical assistance to assure effective and timely implementation of program activities. SECTION Ih SPECIAL PROVISIONS PERFORMING AGENCY shall not develop individual media campaigns (radio, television, cable, billboards, newspaper or merchandise). PERFORMING AGENCY shall concentrate their media efforts on activities that reinforce the advertising campaign messages developed by TDH. . PERFORMING AGENCY shall send a minimum of one (1) stSff member to participate in the State Tobacco Conference on best practices being conducted in the pilot area. PERFORMING AGENCY shall have a minimum of one (1) staff person assigned to the implementation of the activities of this contract. PERFORMING AGENCY shall provide the RECEIVING AGENCY with the name(s) of any key personnel changes that impact the implementation of this contract. General Provisions, Reports Article, is revised to include the following: PROJECT1 PERFORMING AGENCY shall provide monthly reports and quarterly updates to RECEIVING AGENCY Program regarding tobacco community and cessation activities. PROJECT2 PERFORMING AGENCY shall provide monthly reports and quarterly updates to RECEIVING AGENCY program regarding comprehensive tobacco prevention activities. PROJECTS 1 & 2 PERFORMING AGENCY shall maintain specific, detailed documentation of all funded activities including number of people served, type of population served, activity details, training agendas, and' outcome evaluations conducted. PERFORMING AGENCY shall submit these reports by the 15th working day of the month, in a format required by RECEIVING AGENCY. For services satisfactorily rendered pursuant to the Scope of Work set out in Section I above and for meeting the Special Provisions set out in Section II above, the RECEIVING AGENCY will pay the PERFORMING AGENCY for actual costs upon receipt and approval of itemized monthly statements of the costs incurred. EXHIBIT A PERFORMI~NG AGENCY shall provide the following activities in the geographical areas listed below. City of Port Arthur A. Focus on community activities that: · Prevent initiation of youth tobacco use including increasing the unity of youth with schools, family and community, · Protect the public from involuntary exposure to environmental tobacco smoke (ETS); and, · Eliminate disparities among diverse/special population groups. Community activities shall include the following on a monthly basis: · Strengthen an existing coalition or create a new coalition to carry out tobacco- use prevention activities; · Increase awareness and educate the community on tobacco issues. Train and educate a minimum of eight (8) key leaders on tobacco issues. These key leaders may be city council members, civic leaders, religious/spiritual leaders, health professionals, minority community leaders, law enforcement, schools officials, or business leaders; · Promote a tobacco-free message at community events and with media contacts; · Counteract tobacco industry marketing and advertising through media advocacy; Use youth to plan and implement activities in the communities; · Participate in a community-wide event to promote tobacco prevention and education efforts; · Involve institutions of higher learning in tobacco-free activities including minorities, people in rural communities, the elderly, and gay communities; · Conduct three (3) of the following environmental tobacco smoke-related activities: o Conduct RECEIVING AGENCY campaign to educate communities on the benefits of smoke-free bars, on ETS issues, and provide tobacco education materials and resources o Educate a minimum of five (5) work sites, including restaurants and bars, on ETS issues and provide tobacco education materials and resources o Increase awareness and educate the community on local tobacco-free ordinances, and/or educate on the need for local ordinances for tobacco- free work sites and public areas o Visit a minimum often (10) day care centers in tile community to educate workers on the benefits of a smoke-free environment and provide materials and resources EXHIBIT - Page I o Work with schools to educate parents on the dangers of ETS through activities that may include Parent-Teacher Associations (PTAs), school nurses, and school counselors · Promote cessation for current users of tobacco products; · Educate a minimum of ten (10) health care providers on the American Cancer Society Quit Line; · Distribute "Tobacco-Free Texas: Clinicians Guide to Tobacco Prevention and Cessation" to clinicians in Port Arthur; .. Conduct merchant education activities such as compliance surveys and position reinforcement campaigns among merchants that are in compliance with state tobacco laws; · Conduct a media event in coordination with RECEIVING AGENCY'S media campaign; and, · Conduct media advocacy activities such as a letter writing campaign, billboards created by local citizens, murals addressing tobacco issues, and activities directly involving youth. B. Focus on cessation activities for current users of tobacco products. Cessation activities shall include the following on a monthly basis: · Work with the local county medical and dental societies to promote the American Cancer Society Quit Line to a minimum of twenty-five (25) health care and dental workers for patient referrals; · Dissemination of information about the American Cancer Society Quit Line to a minimum of ten (10) work sites and health care facilities; · Distribution of a minimum of twenty-five (25) "Tobacco-Free Texas: Clinicians Guide to Tobacco Prevention and Cessation" to clinicians in the city of Port Arthur; and · Conduct a minimum of ten (10) activities to educate work sites and health care providers on tobacco issues regarding cessation. EXHIBIT - Page 2 CERTIFICATION REGARDING LOBBYING CERTIFICATION FOR CONTRACTS~ GRANTS~ LOANS AND COOPERATIVE AGREEMENTS The undersigned certifies, to the best of his or her knowledge and belief that: (1) No federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or an employee of any agency, a member of Congress in connection with the awarding of any federal contract, the making of any federal grant, the making of any federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any federal contract, grant, loan, or cooperative agreement. (2) If any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a member of Congress, an officer or employee of Congress, or an employee of a member of Congress in connection with this federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-Ill, "Disclosure Form to Report Lobbying," in accordance with it's instructions.
