A RESOLUTION TERMINATING A MOWING CONTRACT WITH TURF
PROS OF BEAUMONT, TEXAS OF VACANT AND DEVELOPED
PROPERTIES FOR AREA C-1.
WHEREAS, the City of Port Arthur entered into a contract with Turf Pros of Beaumont,
Texas, for grass-cutting services of privately owned and city owned vacant and developed lots in
an area designated as Area C-1, per Resolution No. 14-069 dated February 4, 2014; and
WHEREAS,Area C-1 is that area of the City of Port Arthur that includes the East side of
Woodworth Blvd/Memorial Blvd to the West side of 9TH Avenue, Lakeshore Drive to Highway
73; and
WHEREAS, the funds budget for this contact have been exhausted. Therefore, it is
necessary to terminate this contract and pay for any outstanding mowing services that were
rendered during this time for the purpose of maintaining public health and safety.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Council of the City of Port Arthur hereby authorizes the
termination of the contract with Turf Pros of Beaumont, Texas and approves payment to Turf Pro
in the amount of $4,858.10, for services rendered during this period.
Section 3. That the City Council authorizes the rebidding of the grass contract for Area
C-1, at a later date.
Section 4. That, in order to maintain public health and safety concerns, the City Council
authorizes the payment to Turf Pros for any grass cutting services that were previously rendered as
delineated in Section 34-81 of the City of Port Arthur Code of Ordinances, Chapter 343 of the Texas
Health and Safety Code, and Chapter 252.022 (a) (2) of the Local Government Code.
Section 5. That, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.
READ, ADOPTED, AND APPROVED, this day of November 2015 A.D., at a
Regular Meeting of the City Council of the City of Port Arthur, Texas by the following Vote:
