RECOMMENDATION
I recommend that the City Council approve P. R. No. 19137 authorizing the City Manager to execute
Change Order #5 to the contract with Excavators and Constructors, LTD. for the Storm Sewer
Improvements Along 5th Street Project decreasing the contract amount by $51,349.39 to a new amount
$1,940,493.86 and increasing the contract term by 17 days to a new total of 308 days.
BACKGROUND
Per Resolution 14-294 a construction contract was awarded to Excavators and Constructors, LTD. for the
Storm Sewer Improvements Along 5th Street Project for a contract amount of$1,991,843.25 and a term of
270 days. Per Resolution 14-534, the City Council approved Change Order No. 1 increasing the contract
term by 4 days to a new term of 274 days. Per Resolution 14-599,the City approved Change Order No. 2
increasing the contract term by 6 days to a new term of 280. Per Resolution 15-184, the City approved
Change Order No. 3 increasing the contract term by 11 days to a new term of 291. Per Resolution 15-
224, the City approved Change Order No. 4 increasing the contract term by 17 days to a new term of 308
days. This change order is the final change order for the Storm Sewer Improvements Along 5th Street
project that will add additional items and remove all items not used in the project and will be a deductive
change order in the amount of$51,349.39 and will increase the contract term by 17 days to a new term of
308 days.
BUDGET/FISCAL EFFECT
Funds are available in the GLO Round 2.1 Program, Project No. I215TH, Account No. 144-1201-532.59-
00.
SUMMARY
I recommend that the City Council approve P. R. No. 19137 authorizing the City Manager to execute
Change Order #5 to the contract with Excavators and Constructors, LTD. for the Storm Sewer
Improvements Along 5th Street Project decreasing the contract amount by $51,349.39 to a new amount
$1,940,493.86 and increasing the contract term by 17 days to a new total of 308 days.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
CHANGE ORDER NO. 05 TO THE CONTRACT BETWEEN THE CITY
OF PORT ARTHUR AND EXCAVATORS AND CONSTRUCTORS, LTD.,
OF PORT ARTHUR, TEXAS AND G.L.O., FOR THE STORM SEWER
IMPROVEMENTS ALONG 5TH STREET PROJECT DECREASING THE
CONTRACT AMOUNT BY $51,349.39 TO A NEW CONTRACT
AMOUNT OF $1,940,493.86. GLO ROUND 2.1 PROGRAM, PROJECT
NO. 1215TH,ACCOUNT# 144-1201-532.59-00.
WHEREAS, per Resolution No. 14-294, the City Council awarded a contract for the
Storm Sewer Improvements along 5th Street project from DeQueen Blvd. to 6th Avenue to
Excavators and Constructors, LTD. of Port Arthur, Texas in the amount of$1,991,843.25 and a
contract time of 270 calendar days; and,
WHEREAS, per Resolution 14-534, the City Council approved Change Order No. 1 to
the contract increasing the contract term by four(4) days to 274 calendar days; and,
WHEREAS, per Resolution 14-599, the City Council approved Change Order No. 2
increasing the contract term by 6 days to a new term of 280 days; and,
WHEREAS, per Resolution 15-184, the City Council approved Change Order No. 3
increasing the contract term by 11 days to a new term of 291 days; and,
WHEREAS, per Resolution 15-224, the City Council approved Change Order No. 4
increasing the contract term by 17 days to a new term of 308 days; and,
WHEREAS, the proposed Change Order No. 5 will add additional items including
increased quantities of driveway repair, sidewalk repair, curb and gutter and modifications to
curb inlets and drop inlets due to the need for a removal of an existing abandoned sanitary sewer
line that conflicted with the installation of the storm sewer system but also decreases other bid
item quantities in the project resulting to a total decreased cost of$51,349.39; and,

WHEREAS, approval of Change Order No. 05 will decrease the contract amount by
$51,349.39 to a new total of$1,940,493.86 attached hereto as Exhibit"A"; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, Change Order No. 05 is herein approved and the City Manager is authorized to
execute said Change Order No. 05 (attached as Exhibit "A") to the contract between the City of
Port Arthur and Excavators and Constructors, LTD.; and,
THAT, Change Order No. 05 decreases the contract amount by $51,349.39 to new
contract amount of$1,940,493.86; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

Dear Mr. Baaheth:
Attached is Change Order No. 5 for the Storm Sewer Improvements along 5th Street project.
This change order is the final change order for the Storm Sewer Improvements along 51h Street
that will add additional items and remove all items not used in the project. The additional items
including increased quantities of driveway repair, sidewalk repair, curb and gutter and
modifications to inlets and drop inlets. The additional driveway, sidewalk and curb and gutter
were needed for the removal of an existing abandoned sanitary sewer line that conflicted with
the installation of the storm sewer system. The modifications to the inlets and drop inlets were to
change the elevations of the storm sewer leads to avoid conflicts with the existing waterline and
sanitary sewer system. I recommend that the City of Port Arthur authorize this change to the
contract. I have attached Change Order No. 5 which modifies the contract to reflect this change
for your consideration and action. Should you have any questions or require additional
