Mrs._ Wood stated she is Chairman of the White Haven House Committee and
that the idea of a Bed and Breakfast had been suggested by a number of
people, Mrs= Wood stated the home does not have an endowment and needs a
way to generate income=

Mr= Watson stated the 3200 square font home is located in Planned
Development CPD -9l District and two rooms are to be rented= Mr= Watson
stated stationery would be sold and group functions would be held there.
Mr_ Watson stated off-street parking would be provided in the rear of the
home and exit onto 4th Street_
Mr. Watson stated the Bed and Breakfast Ordinance and the amendment to
the _zoning Ordinance were passed to encourage owners of homes built
before 1950 to reside in those homes and to provide maintenance necessary
to preserve the historical and architectural value of the structures, to

ensure the integrity of the neighborhoods in which the structures are
located by providing for bed and breakfast operating standards, to
strengthen the local economy and to promote the historical interest and
pride in the community=
Mr= Matson stated the ordinance provides that any Specific Use Permit
shall not be issued unless the following findings are made-
1. Public facilities, services and utilities are reasonably available.
2. The use will have no harmful effect upon the surrounding
neighborhood=
3= The use will not generate excessive traffic, considering the capacity
and physical character of the surrounding streets=
4. The site is suitable for the type and intensity of the use or
development proposed.
Mr, Watson farther stated the ordinance requires that in the case that a
facility is owned by a nonprofit; that a "guest host" may reside on the
premises in a permanent manner- The caretaker of "White Haven" will act
as the guest host for this Sed and Breakfast,
Mr. Matson stated the application appears to meet the purposes and
requirements established for the Bed and Breakfast use, Mr. Watson
stated staff's recommendation is approval,

Mr- Robbins stated he is the owner of the home and proposes the Bed and
Breakfast= Mrs Robbins stated he originally came to Port Arthur in 1947
and moved to Lake Charles in 1952= After retirement, he moved back to
Port Arthur and as introduced by Gerald Buchanan, purchased the home=
Mr= Robbins stated he and his wife are people -people and want to share
their home, its ambience and promote Port Arthur. Mr. Robbins stated
that two Bed and Breakfast locations are better than one- Mr. Robbins
stated time and effort would be devoted to make Part Arthur proud=

The Bed and Breakfast Ordinance and the amendment to the Zoning
Ordinance was passed for the following purposes:
1. To encourage owners of homes built before 1950 to continue to reside
in those homes and to provide maintenance necessary to',preserve the
historical and architectural value of the structure.
2. To ensure the integrity of the neighborhoods in which these
structures are located by providing for bed and breakfast operating
standards.
3. To strengthen the local economy,
4. To promote historical interest and pride in the community.'
Furthermore, the Ordinance provides that any Specific Use Permit shall
not be issued unless the following findings are made.
1. Public facilities, services and utilities are reasonably available.
2. The use will have no harmful effect upon the surrounding
neighborhood.
3. The use will not generate excessive traffic, considering the
capacity and physical character of the surrounding streets. i
4. The site is suitable for the type and intensity of the',use or
development proposed.
The ordinance requires that in the case of a facility is Qwned by a
nonprofit that a "guest host" may reside on the premises 'in a permanent
manner. The caretaker of "White Haven" will act as the guest host for
this Bed and Breakfast. I I i
Off-street parking will be located to the rear of the -structure and
exit onto 4th St.

Mr. Watson explained the proposed amendment would amend Planned Development
District -9 (PD -9) to permit the Bed and Breakfast, Private Home by right and delete
the preservation standards in conflict with the Historic Preservation Ordinance. Mr.
Watson stated the City Council feels that this area in one in which Bed and Breakfast
uses should be encouraged and that interested parties should not have to go through
the zoning process if they meet the requirements of the Bed and Breakfast
Ordinance. Mr. Watson stated of 34 notices mailed, 13 were returned, 11 in favor, 2
in protest. Mr. Watson stated staffs recommendation is to recommend approval of
Zoning Case Z97-10 to the City Council.
COMMISSION ACTION.
Motion was made by Mr. Todora to recommend approval of Zoning Case Z97-10 to the
City Council. Seconded by Mr. Harrison. All yes.

WHEREAS, all the requirements of Article XI of the Charter and
the Zoning Ordinance, of the City of Port Arthur, Texas, including
the Local Government Code, Sections 211.006 and 211.007, having been
fulfilled, the City Council held a public hearing March 11, 1997, at
9:00 A.M. and,
WHEREAS, the proposed change has not been protested in
accordance with subsection (d) of said Section 211.006; and,
WHEREAS, having received and considered the recommendation of
the Planning and Zoning Commission that the proposed change be
approved, the City Council finds that it would be in the public
interest and general welfare of the City to change the Zoning
designation of the hereinafter described property; and,
WHEREAS, pursuant to subsections (d) and (f) of Section 211.006
Local Government Code, Section 24-105 of the City Zoning Ordinance
requires, in order for the proposed change to take effect, the
affirmative vote of at least three --fourths of all members of the
City Council (i..e., at least seven [7] members) if the proposed
change is protested in accordance with said subsection (d) or the
City's Planning and Zoning Commission recommends that the proposed
change to a regulation or boundary bis denied; now, therefore,

SECTION 7. Any person, firm or corporation who violates any
provision of this Ordinance or the City's Zoning Ordinance shall be
guilty of a misdemeanor and shall be punished by a fine not
exceeding Two Thousand ($2,000.00) Dollars as provided in Section
1-8 of the Code of Ordinances, and each day such violation shall be
permitted to exist shall constitute a separate offense.
SECTION 8. This Ordinance or its caption and penalty shall be
published at least one (1) time within ten days after final passage
hereof in the official newspaper of the City of Port Arthur. This
Ordinance shall take effect immediately after the date of such
publication.
SECTION 9. Because Section 24-105 of the Zoning Ordinance does
not apply, seven (7) votes are not required to adopt this Ordinance.

Zoning Commission that the proposed change be approved, the City Council finds that it

Commission, so as to reflect on said Map, the changes hereby made in conformity with the
legend of said Map.
SECTION 6. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision
and such holding shall not affect the validity of the remaining portions hereof.
SECTION 7. All ordinances and parts of ordinances in conflict herewith are hereby
repealed, but only to the extent of such conflict.
SECTION 8. Any person, firm or corporation who violates any provision of this
Ordinance or the. City's Zoning Ordinance shall be guilty of a misdemeanor and shall be
punished by a fine not exceeding Two Thousand ($2,000.00) Dollars as provided in
