Date: December 31, 2015 To: Brian McDougal, City Manager From: Rawetts Baaheth, Sr., Acting Director of Public Works `- RE: Proposed Resolution No. 19264 RECOMMENDATION I recommend that the City Council approve P. R. No. 19264 authorizing the City Manager to execute Change Order#4 to the contract with ALLCO for the Bluebonnet Avenue Street Improvements increasing the contract amount by $59,338.56 to a new amount $2,206,962.84 and increasing the term by 30 days to a new term of 425 days. BACKGROUND Per Resolution 15-024 a construction contract was awarded to ALLCO. Inc. for the Bluebonnet Avenue Street Improvements Project for $1,801,610.00 and a contract term of 270 days.. Per Resolution 15-173, the City Council approved Change Order No. 1 increasing the contract amount by $24,843.78 to a new contract total of$1,826,453.78 for emergency repairs to the roadway subgrade. Per Resolution 15-204, the City approved Change Order No. 2 increasing the contract amount by $238,152.00 to a new contract amount of$2,064,605.78 and increasing the contract term by 90 days to a new term of 360 days due to additional repairs. Per Resolution 15-388, the City approved Change Order No. 3 increasing the contract amount by $83,018.50 to a new contract amount of$ 2,147,624.28 and increasing the contract term by 35 days to a new term of 395 days due to additional repairs. This change order is for additional milling of the asphalt surface requested by the City to provide a thorough inspection of the concrete roadway base increasing milling bid items on the contract. BUDGET/FISCAL EFFECT Funds are available in the GLO Round 2.2 Program, Project No. 122BB, Account No. 145-1201-532.59- 00 SUMMARY I recommend that the City Council approve P. R. No. 19264 authorizing the City Manager to execute Change Order#4 to the contract with ALLCO for the Bluebonnet Avenue Street Improvements increasing the contract amount by $59,338.56 to a new amount $2,206,962.84 and increasing the term by 30 days to a new term of 425 days. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 04 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND ALLCO, INC. FOR THE BLUEBONNET AVENUE STREET IMPROVEMENTS PROJECT INCREASING THE CONTRACT AMOUNT BY $59,338.56 TO A NEW CONTRACT AMOUNT OF $2,206,962.84, INCREASING THE CONTRACT TERM BY 30 DAYS TO A NEW TERM OF 425 DAYS. GLO ROUND 2.2 PROGRAM,PROJECT NO. I22BB,ACCOUNT# 145-1201-532.59-00. WHEREAS, per Resolution No. 15-024, the City Council awarded a contract for the Bluebonnet Avenue Improvements project from Gilham Circle to 19th Street to ALLCO, Inc., of Beaumont, Texas in the amount of$1,801,610.00 and a contract time of 270 calendar days; and, WHEREAS, per Resolution 15-173, the City Council approved Change Order No. 1 to the contract in the amount of $24,843.78 increasing the contract amount to $1,826,453.78 for emergency repairs to the roadway subgrade due to a large void under the roadway created by a water main leak; and, WHEREAS, per Resolution 15-204, the City Council approved Change Order No. 2 increasing the contract amount by $238,152.00 to a new contract amount of$2,064,605.78 and increasing the contract term by 90 days to a new term of 360 days due to additional repairs; and, WHEREAS, per Resolution 15-388, the City Council approved Change Order No. 3 increasing the contract amount by $83,018.50 to a new contract amount of$2,147.624.28 and increasing the contract term by 35 days to a new term of 395 days due to additional repairs; and, WHEREAS, the proposed Change Order No. 4 is for additional milling of the asphalt surface. ALLCO was instructed to mill the first two inches (2") of the existing surface for a new driving surface. After the initial milling operations, the City requested to mill all of the existing surface to provide a thorough inspection of the concrete roadway base increasing bid items P.R. 19264 Page 2 "Mill and Haul Off Existing Surface" by 1,115 S.Y. for a subtotal of $7,247.50 and "Re-Mill Roadway by 8,653 S.Y. for a subtotal of$52,091.06 to a combined total of$59,338.56; and, WHEREAS, approval of Change Order No. 04 will increase the contract amount by $59,338.56 to a new total of$2,206,962.84 and increasing the contract term by 30 days to a new term of 425 days herein deemed an appropriate action, attached hereto as Exhibit "A"; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, Change Order No. 04 is herein approved and the City Manager is authorized to execute said Change Order No. 04 (attached as Exhibit "A") to the contract between the City of Port Arthur and ALLCO, Inc.; and, THAT, Change Order No. 04 increases the contract time by 30 days to a new term of 425 days for a completion date of May 27, 2016 and also increases the contract amount by $59,338.56 to new contract amount of$2,206,962.84; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This change order is for additional milling of the asphalt surface on Bluebonnet Avenue. The was instructed to mill 2" of the existing surface for a new driving surface. After the milling was complete the contractor was requested to mill all of the existing surface to allow for a thorough inspection of the concrete roadway base. The total cost for this change order will increase the contract amount $59,338.56. I recommend that the City of Port Arthur authorize this change to the contract. I have attached Change Order No. 4 which modifies the contract to reflect this change for your consideration and action.
