AN ORDINANCE CLOSING TO VEHICULAR TRAFFIC THE ALLEY BEHIND THE PORT ARTHUR TRANSIT TERMINAL (322 PROCTER) AND THE ADMINISTRATION BUILDING (344 PROCTER) AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, pursuant to Section 272.001, Texas Local Government Code, Section 311.007 of the Texas Transportation Code, and Article I, Section 7 of the Charter of the City of Port Arthur, the City has the authority to close, abandon, or vacate streets, public rights-of-way, alleys and easements, subject to the provisions of Article VI (Abandoning and Vacating City Streets, Alleys and Easements; Conveying, Selling, and exchanging City Land) of Chapter 94 of the Code of Ordinances of the City of Port Arthur; and, WHEREAS, within the city of Port Arthur an alley extends between Dallas Avenue and Fort Worth Avenue and lies between Procter Street and Fourth Street, as shown on a map attached hereto as Exhibit "A;" and, WHEREAS, the Port Arthur Transit administrative personnel have recently moved into the new Port Arthur Transit Administration Office Building, 344 Procter Street; and, WHEREAS, the P.A.T. manager has determined that the department could more effectively and efficiently use the 20-foot-wide alley way between the Transit Page 1 of 5 P.O. No. 6516 01/08/2016 peb the Transit Terminal, 322 Procter Street, and the Transit Garage, 300 Dallas Avenue, and between the Administration Office Building and the Transit vehicle parking lot, by closing the alley to public traffic (with the exception of the 25-foot-wide section of alley behind 348 Procter Street, owned by Port Cities Rescue Mission) and using the closed alley way for parking and more efficient foot traffic between the administrative offices and the transit garage; and WHEREAS, the City Council recognizes that the alley way does serve as a utility easement for a public drinking water line and a sanitary sewer line, as well as for overhead electrical and other utility lines; and, WHEREAS, the City Council finds that the alley is not commonly used as a public thoroughfare and serves little, if any, traffic purpose for the public; and, WHEREAS, the City Council finds that closing 11/ 12th of the alley will not negatively affect the utility easement or prevent city crews, or other utility crews, from repairing or replacing any utility lines; and, WHEREAS, the City Council finds that closing the alley to vehicular traffic (with the exception of the 25-foot section of alley behind 348 Procter Street) creates no adverse effect on the only privately-owned lot in Block 138, 348 Procter Street, held in the name of Port Cities Rescue Mission; and, Page 2 of 5 P.O. No. 6516 01/08/2016 peb WHEREAS, closing 11/ 12th of the alley's length to traffic would allow, at any time in the future, for the alley to be reopened to traffic if such reopening were deemed prudent and purposeful by the City Council; and, WHEREAS, the City Council has determined that it is in the best interest of the City to close to vehicular traffic 11/ 12th of this alley that extends between Dallas Avenue and Fort Worth Avenue and lies between Procter Street and Fourth Street; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. The City Council hereby closes the portion of the alley as delineated in "Exhibit A." Section 2. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed, but only to the extent of such conflict. Section 4. This Ordinance or its caption and penalty shall be published at least one (1) time within ten days after final passage hereof in Page 3 of 5 P.O. No. 6516 01/08/2016 peb the official newspaper of the City of Port Arthur. This Ordinance shall take effect immediately after the date of such publication.
