Director of Public Works P.O. #5249 April 3, 2002 RECOMMENDATION: I recommend that the City Council approve Proposed Ordinance #5249 declaring the non- use of certain railroad tracks crossing public streets in the City of Port Arthur, Texas BACKGROUND: Certain railroad tracks crossing public streets in the City of Port Arthur are no longer in use by the railroad under whose ownership the tracks fall. Tracks considered to be no longer in use are ones (A) that have been paved over and no rail shows; (B) that have had the rails disconnected on one or both sides of the street that they cross; (C) where the crossing and adjacent rails are known to have been removed; and (D) where tracks have been disconnected from the main tracks serving them. The particular tracks are: 1. Crossing D35 Union Pacific Houston Avenue north of 19~h Street D 2. Crossing D36 Union Pacific San Antonio Avenue south of 19th Street D 3. Crossing D37 Union Pacific 18~h Street east of Dallas Avenue D 4. Crossing D38 Union Pacific 17~h Street east of Fort Worth Avenue D 5. Crossing D39 Union Pacific Gulfway Drive west of Austin Avenue D 6. Crossing D40 (so declared by Ord. 98-11, February 24, 1998) A 7. Crossing D41 Union Pacific 14th Street west of Austin Avenue D 8. Crossing D42 Union Pacific 12th Street west of Austin Avenue D 9. Crossing 1343 Union Pacific Thomas BIvd (N) west of Austin Avenue D 10. Crossing D44 Union Pacific Thomas Blvd. (S) west of Austin Avenue D 11. Crossing 1345 Union Pacific 9th Street (VV) west of Austin Avenue D 12. Crossing [346 Union Pacific 9Ih Street (E) east of Austin Avenue D Locations are shown on the map attached tO the proposed ordinance. Union Pacific Railroad Company has been notified of the proposed action by letter dated March 8, 2002. Crossings identified as no longer in use can only be returned to service upon application for and granting of a permit by the City for each crossing, and each track restored must be built to the same standards, including street crossing material, as adjacent or nearby crossings. WHEREAS, certain railroad tracks crossing public streets in the City of Port Arthur are no longer used by the railroad under whose ownership the tracks fall; and, WHEREAS, those tracks considered to be no longer in use are ones: (A) that have been paved over and no rails show; (B) that have had the rails disconnected on one or both sides of the street that they cross; (C) where the crossing and adjacent rails are known to have been removed; and (D) where tracks have been disconnected from the main tracks serving them; and, WHEREAS, Union Pacific Railroad Company has been notified of the proposed action by letter dated March 8, 2002; now, therefore; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the following railroad track crossings identified by City inventory number and/or location are hereby declared to be no longer in use by the Union Pacific Railroad Company: CROSSING RAILROAD LOCATION REASON 1. Crossing D46 Union Pacific Houston Avenue north of 19~h Street D Union Pacific San Antonio Avenue south of 19th Street D Union Pacific 18th Street east of Dallas Avenue D Union Pacific 17th Street east of Fort Worth Avenue D Union Pacific Gulfway Drive west of Austin Avenue D (so declared by Ord. 98-11, February 24, 1998) Union Pacific 14th Street west of Austin Avenue Union Pacific Union Pacific Union Pacific Union Pacific Union Pacific D 12a Street west of Austin Avenue D Thomas BIvd (N) west of Austin Avenue D Thomas Blvd. (S) west of Austin Avenue D 9~h Street (VV) west of Austin Avenue D 9~h Street (E) east of Austin Avenue D P.O. #5249 Page #2 THAT the locations of the above referenced tracks are more fully shown on Exhibit "A" attached hereto and made a part hereof; and, THAT the Union Pacific Railroad Company branch line of which these crossings are a part has been removed at the point where it crossed the Kansas City Southern Railway lines west of crossing D35; and, THAT the referenced tracks no longer in use can only be returned to service upon the application for and granting of a permit by the City for each track; and, THAT each track returned to service must be built to the same standards, including street crossing material, as adjacent or nearby crossings; and, THAT Union Pacific Railroad Company will be notified of this action by certified mail bythe Acting City Secretary; and, THAT a caption of this Ordinance be spread upon the Minutes of this meeting.
