No. 19304 calling for a public hearing to consider a proposed abandonment for 0.0074 acre of land consisting of a 2.5' x 114' portion of the 7.5' X 114' utility easement located on Lot 11, Block 31, Lakeside Park Unit 4 in Port Arthur, Texas. The purpose of this request is for the construction of a new residential structure. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A PROPOSED ABANDONMENT FOR 0.0074 ACRE OF LAND CONSISTING OF A 2.5' X 114' PORTION OF THE 7.5' X 114' UTILITY EASEMENT LOCATED ON LOT 11, BLOCK 31, LAKESIDE PARK UNIT 4, CITY OF PORT ARTHUR,JEFFERSON COUNTY, TEXAS A16-01 (KATHY WHITE) WHEREAS, the applicant — Kathy White, is requesting that the City of Port Arthur consider this abandonment for the area delineated in Exhibit"A"; and, WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to consider the abandoning, vacating and relinquishing streets, alleys and easements; and, WHEREAS,the City Council has the authority to vacate, abandon or close a street under Section 311.001 and 311.007 Transportation Code; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That the Planning and Zoning Commission heard this case on February 1, 2016. SECTION 3. That upon abandoning and vacating the alleys, the City shall have the right, if it so desires,to retain utility easements. SECTION 4. That a public hearing to consider whether to grant the applicant the abandonments as delineated in Exhibit "A" shall be held on March 22, 2016 at 9:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 Fourth Street. That notice of the public hearing shall be published at least fifteen (15) days before the date of the hearing in the official newspaper of the City pursuant to 211.006 of the Texas Local Government Code. SECTION 6. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council.
